The Iraqi Communist Party reported on Sunday that it had won the “final accounts” lawsuit and obliged the Council of Ministers and the Ministry of Finance to submit them on time .
The party's media said in a statement, seen by Al-Iqtisad News, that "the Federal Supreme Court obligated both the Council of Ministers and the Minister of Finance to submit the final accounts in implementation of the Iraqi Constitution, based on the lawsuit filed by the Secretary of the Central Committee of the Iraqi Communist Party, Raed Fahmi, after many fights." The case’s lawyer, Zuhair Diaa El-Din, was quoted as saying, “The Federal Supreme Court issued a decision, today, in Case No. 190 of 2023, which was filed by plaintiff Raed Jahid Fahmy, through lawyers Zuhair Diaa El-Din and Salam Zuhair Diaa El-Din,” indicating that “ Accordingly, it ruled to oblige both the Council of Ministers and the Minister of Finance to submit the final accounts in implementation of the text of Article (62/First) of the Constitution, which stipulates (the Council of Ministers shall submit the general budget law and the final account to the House of Representatives for approval) and in accordance with the provisions of Article 34 of the Financial Management Law No. 6 of the year 2019 .
He added, "This decision constitutes a major achievement, as the state's final accounts reflect the processes of applying the general budget in accordance with the legal regulations, rules, and financial instructions in force to show the state's financial position, including its collectible rights and its payable obligations. "
He explained, "The Council of Ministers and the Ministry of Finance were slow in submitting the final accounts, as the last accounts submitted were for the year 2018, which were submitted years behind their schedule ."
Lawyer Diaa Al-Din indicated, “We hope that after the issuance of the decision of the Federal Supreme Court above, the Council of Ministers and the Ministry of Finance will commit to completing and submitting the final accounts for the ending year with every budget that is referred to the House of Representatives for the purpose of approval in implementation of the decision of the Federal Supreme Court, whose decisions are considered final and binding on all authorities based on According to the text of Article 94 of the Constitution .”
