The federal government is scheduled to continue funding the salaries of employees in the Kurdistan Region after the Federal Supreme Court issued a decision that stipulated the necessity of distributing employee salaries and working to localize salaries.
The federal government financed employee salaries for the months of February and March according to the lists sent by the Kurdistan Regional Government, and it is expected that this funding will continue until employee salaries are localized in government banks affiliated with the federal government.
The salaries will be paid by the federal government.
The representative of the Patriotic Union of Kurdistan bloc, Jarro Hama Sharif, told PUKMEDIA: Funding the salaries of employees in the Kurdistan Region will continue according to the agreement signed between the Kurdistan Regional Government and the federal government.
She added: The salaries of employees in the Kurdistan Region will be paid with the salaries of employees in the federal government every month until nationalization procedures take place, as the Federal Court confirmed in its decision regarding employee salaries.
Localization in government banks
MP Jarro Hama Sharif says: The process of localization of employee salaries must take place in government banks affiliated with the federal government, as announced by the Federal Court.
She added: We are waiting for the federal government to continue funding the salaries of employees in the Kurdistan Region from the 18th until the end of this month, with the salaries of its employees being distributed by the Federal Ministry of Finance.
The Finance Committee discusses financing employee salaries.
Member of the Parliamentary Finance Committee, MP Mustafa Al-Karawi, said during a special statement to PUKMEDIA: The issue of employee salaries in the Kurdistan Region will be discussed by the Finance Committee tomorrow, Monday.
He added: The issue of employee salaries in the Kurdistan Region has been dealt with temporarily through funding according to the federal budget without localization and some other measures.
Continuation of funding salaries.
Representative Mustafa Al-Karaawi says: Funding the salaries of employees in the Kurdistan Region is supposed to continue according to the Federal Budget Law, and that the federal government begins distributing the salaries of its employees starting on the 18th of each month, and each ministry is funded according to the funding date.
He added: The Parliamentary Finance Committee will meet tomorrow, Monday, and one of the topics being discussed is the issue of financing employee salaries in the Kurdistan Region.
The Federal Court’s decision on the localization and disbursement of salaries
. The Federal Supreme Court held its session on a number of complaints, including those related to the salaries of employees of the Kurdistan Region within the case numbered (224 and its units 269\Federal\2023) and issued its decision to oblige the localization of the salaries of all employees of the region.
Below is the text of the decision:
“First: The defendants oblige the Prime Minister of the Federal Government, and the Prime Minister of the Kurdistan Region - Iraq, to localize the salaries of employees of all ministries, governorates, and entities not affiliated with a ministry, and all employees of other government agencies, retirees, and beneficiaries of the social protection network at federal government banks operating outside the region, and deduct them from The region’s share specified in accordance with the budget law for this year and for the coming years. Each of the aforementioned parties in the region and its subsidiary departments has direct coordination with the Federal Ministry of Finance to implement this and approach it regarding resettlement without referring to the Kurdistan region’s representation, and all banks affiliated with the first defendant must facilitate the resettlement process. And follow all necessary means to ensure that the beneficiary (employee, public service officer, retiree, or social protection network beneficiary) can obtain his salary at his place of residence through the outlets spread in the region or the banks open in the region licensed by the Central Bank of Iraq, and the highest official within the aforementioned authorities is responsible. Above, the ministries and entities not affiliated with a ministry and all government formations are responsible for the accuracy of the data sent for the purpose of nationalization regarding the number, grade, amount of salary or wage, and beneficiary data, and it must be signed by the supreme president, the director of financial audit, the director of the financial department, and the director of the human resources department, provided that the plaintiff The first should launch funding for the salaries of employees in the region after resettlement and not finance them through loans.
Second: Obliging all entities mentioned in Paragraph (First) above within the region to submit monthly trial balances on the date determined by the Accounting Department of the Federal Ministry of Finance in the following month when requesting funding, similar to the ministries of the federal government.
Third: Obliging the second defendant, the Prime Minister of the region, to hand over all of his oil and non-oil revenues to the federal government (the state treasury), in accordance with the Federal Financial Management Law, provided that the Federal Office of Financial Supervision, in coordination with the Office of Financial Supervision in the region, audits the data related to those revenues based on the provisions of Article (12) of Law No. (13) of 2023, the federal general budget of the Republic of Iraq for the fiscal years (2023-2024-2025).
Fourth: Obliging the second defendant to enable the Federal Financial Supervision Bureau, in coordination with the Financial Supervision Bureau in the region, to audit the bank accounts opened in the region within the Central Bank and to audit the lists of employees, retirees, and beneficiaries of the social protection network in the region.
It is noteworthy that the decision of the Federal Court was issued by agreement and is final and binding on all authorities. .
