    The Parliamentary Legal Committee expected, on Tuesday, that the formulation of the Sharia code related to the Personal Status Law by the Sunni and Shiite endowments may lead to disagreements and going to obtain the code from religious authorities.

    While committee member Mohammed Al-Khafaji acknowledged the difficulty of passing the amendment to the Personal Status Law easily, he pointed out that “the current law, despite being strong in terms of law and wording, includes some provisions that conflict with Islamic law, which prompted some judges to try to adapt the general articles to be consistent with Sharia.”


    He considered that "the existence of clear and explicit laws will eliminate the need for such adaptations, and prevent any violations, especially in cases related to custody and wills," according to the government newspaper Al-Sabah. He

    explained that "there are two options regarding the current law; the first is to keep it as it is, and the second is to add clear Sharia provisions that are compatible with Sharia and to codify these provisions within legal articles that are in line with the four schools of thought or Shiite jurisprudence."

    He pointed out that "the code will be covered by Sharia provisions that are formulated by the Sunni and Shiite endowments, with the possibility of disagreements that may lead to obtaining the code from religious references to present it to Parliament."
