The Board of Commissioners challenges the government's decision
30/8/2018 12:00 am [rtl] Baghdad / Al-Sabah The Commission of Commissioners in the Electoral Commission expressed surprise at the issuance of the recent decision of the Council of Ministers on the continued suspension of the work of the Board of Commissioners on the exercise of his functions, stressing that he will use the legal methods to challenge decisions affecting the independence of the Commission in accordance with the Constitution. In a statement received by al-Sabah, the council promised that it represents a violation of the principle of separation of powers and the work of independent bodies, considering that the election commission is subject to the control of the parliament, which is a problem before it in accordance with article 102 of the constitution. He explained that «the Council of Ministers violated his recent decision on the basis of the third amendment to the law of the election of the Council of Representatives No. 45 of 2013 amended, while the provisions of the amendment came clear regarding the suspension of the work of commissioners and directors of provincial offices and until the completion of the investigation of fraud crimes». He added, "There was a five-member ministerial committee to investigate this. The committee has completed its work and submitted its recommendations according to its letter No. 1/3/1/14810 dated 15/7/2018 to the Prime Minister, who in turn approved its recommendations and sent them according to the letter of the Secretariat of the Council of Ministers No. 2/1/65/42/2539 / dated 25/7/2018 to the Board of Commissioners of the assigned judges and a decision was issued to implement the recommendations, namely the removal of three directors from the provincial offices and two employees ». He pointed out that «after the end of the work of the judges assigned by the ratification of the Federal Court on the results on 19/8/2018, which proved a great match in the results by nearly 99% and after their disconnection on August 20, the commissioners and office managers were directly to their work, : (Suspension of work shall end with the conclusion of the investigation of the crimes of forgery), which is already non-existent, especially after the results match. The Council of Commissioners stressed that "the legal methods will be used to challenge decisions affecting the independence of the Commission in accordance with the Constitution and its law No. 11 of 2007. Prime Minister Haider Abadi, announced on Tuesday evening that all decisions issued by the Electoral Commission are void until the completion of the investigation of crimes Fraud ".
