Today, Sunday, the representative of the resigned Sadrist bloc, Ghayeb Al-Amiri, expressed his surprise at the delay in issuing an arrest warrant against the leader of the Law Coalition, Nuri al-Maliki, until now, after the audio leaks attributed to him .
Al-Amiri said in his blog, followed by the National News Center: “Article 195 stipulates penalties: Whoever aims to provoke a civil war or sectarian strife by arming citizens, or forcing them to arm one another against each other, or inciting fighting, shall be punished with life imprisonment.”
He explained, “The penalty will be the death penalty if what the offender aimed at (classifying this crime as a felony) is achieved. The penalty is life imprisonment if one of the following cases is achieved:
- If he aims to provoke a civil war by arming citizens, forcing them to arm or inciting fighting.
- If it aims to provoke sectarian fighting by arming the citizens or forcing them to arm one another against each other, or urging them to fight.”
Noting, "The penalty for it is the death penalty if the perpetrator's goal is achieved, and therefore the crime exists by merely declaring and calling for fighting and arming citizens against each other."
Al-Amiri added, “What al-Maliki mentioned in the leaks is sufficient to carry out criminal responsibility in accordance with Article 195 of the penalty,” noting that “we do not want anything more than achieving justice and applying the law against those who aimed to provoke a civil war and fighting between the people of the same country and arming people to kill each other.”
Al-Amiri added that "what the aforementioned said combines all of the above-mentioned punitive article, and we are surprised at the delay in issuing an arrest warrant against him so far for a crime that carries a sentence of life imprisonment and death."
