    Shafaq News/ The general amnesty law faces an ambiguous fate, despite the existence of a political agreement during the formation of the government of Muhammad Shia al-Sudani on its legislation, and observers indicate that there is a political will, especially by the coordination framework, to disrupt the law and not abide by the promises previously granted to other parties (Sunnis) to ensure their participation in the new government.



    Specialists assert that approving the general amnesty law will do justice to large groups, contribute to strengthening societal peace, increase citizen confidence in the government, and save a large segment of those who are in prisons for reasons, some of which may be force majeure beyond the control of the convict.
    The government program, according to deputies from the Sunni component, includes the issuance of a general amnesty law, security checks in their governorates, and the abolition or suspension of agencies that were a source of concern and crisis for them.
    The "state administration" is threatened with disintegration
    In this context, the representative of the Sovereignty Coalition, Fahd Al-Rashed, says, "The general amnesty law is among the most important negotiating papers we have, such as the Sovereignty Coalition, which considers (the Sovereignty Coalition) the general amnesty law, absentees, accountability, justice, compensation for liberated areas, and political balance at all levels among the most important negotiating papers." ".
    Al-Rashed explained to Shafaq News agency, "There is a political agreement at the level of the state administration coalition in this regard, and otherwise, I think that the political process and the state administration alliance is threatened with disintegration."
    Last Friday, the head of the Sovereignty Coalition, Khamis Al-Khanjar, called on the government and parliament to pass a general amnesty law before the end of Ramadan, in accordance with the political agreement on the basis of which the government of Muhammad Shia’a al-Sudani was formed.

    For his part, the head of the National Dialogue Front and former deputy prime minister, Saleh al-Mutlaq, says, "Iraq has passed an important stage that was difficult for the Iraqis, which is the security challenge that Iraq was facing because of ISIS and sectarianism in the country, and after the elimination of ISIS and the end of sectarianism - at least socially." - It is required to start with a comprehensive national reconciliation that calms the situation in order to start a new phase of construction and development.
    Al-Mutlaq added to Shafaq News agency, "The moral, humanitarian, and legal aspect, and the interest of the country all require overcoming this stage, and starting with a real reconciliation that begins with a general amnesty law for Iraqis, especially those from whom confessions were extracted by force, because of the secret informant and other reasons due to the sectarian tension at the time that prevailed in the regimes." previous".
    Al-Mutlaq explains, "There is a political agreement during the formation of the Sudanese government to legislate the amnesty law, but these concessions and bids that are given at the time of the elections and the formation of the government are quickly abandoned after the completion of its formation, which ends the mutual trust between society and the political blocs, and between the political blocs." With each other".
    Al-Mutlaq stresses the necessity of "starting with a new and rapid phase in applying the political agreements that took place, including the general amnesty, accountability and justice laws, and if a general amnesty law is not issued, then at least the defendants should be re-investigated so that the injustice of those who were judged - at the time - unjustly because of Confidential informant or false witness."   
    Why deactivate?
    Researcher at the Raman Center for Research and Consultation, Shaho Al-Qara Daghi, explains, “Implementing the amnesty law simply means acknowledging the adoption of sectarian measures and previously illegal actions, filling prisons with innocent people as a result of secret informant and malicious accusations or for revenge purposes, settling scores and condemning many parties that contributed to this matter.” ".
    Al-Qaradaghi explains to Shafaq News agency, "The parties to the coordination framework cannot transcend the past, or adopt different policies, and they still adhere to some policies and perceptions that have contributed to the political and social crises that Iraq suffers from until now, and that obstructing this law may affect the political agreements that I contributed to the formation of the new government, thus influencing the Sudanese government directly.
    There is no amnesty law.
    The legal expert, Amir Al-Daami, reveals that "there is no general amnesty law on the ground," indicating during his interview with Shafaq News agency, that "all that is raised about it are rumors and mere gossip to flatter the feelings of the grieving people, as there is not even a draft law."  
    The importance of the amnesty law 
    In turn, the legal expert, Ali Al-Tamimi, believes that “the Sudanese government’s hastening to submit a draft of the general amnesty law to parliament is a necessity that has become urgent for many factors and reasons, the most important of which is that the new reformist governments in all countries of the world seek to pass general amnesty laws to start a new page with the people who have suffered from calamities and accumulations.” previous governments.
    Al-Tamimi added to Shafaq News agency, "The important positive laws ensured the general amnesty, such as the Iraqi Penal Code No. 111 of 1969 with articles 150 and 153, and the Code of Criminal Procedure No. 23 of 1971 with articles 300, 301, 304 and 305", indicating that what calls for and motivates the amnesty as a starting point Islamic is the Almighty’s saying: “Forgive and pardon” (Al-Ma’idah 13), and the Almighty’s saying: “For God is Pardoning, Powerful” (An-Nisa’ 149).
    He points out that "the increase in the costs of prisoners such as feeding, treatment, electricity and water in light of the high price of the dollar, which costs the state budget huge sums, in light of the great austerity and the low price of a barrel of oil," explaining, on the other hand, that "many parliamentary and governmental circles have indicated suspicions of corruption in prisons." And by approving the amnesty, these suspicions and doubts will be removed.”
    Al-Tamimi believes that "the great economic motives and destitution pushed many to engage in crimes of theft, extortion, and armed robbery for the purpose of living, and the importance of the general amnesty is to eliminate the hatcheries of terrorism inside prisons, which are carried out by a few, and which are trying to change the pattern of prisons with desperate attempts from reformatory to outposts." Atonement and hate.
    And he states that "in 2008, Amnesty Law No. 19 was issued, and the other amnesty law was issued in 2016, No. 27, which was comprehensive except for some exceptions, and here the government must approve the amnesty law because Iraq is an exceptional case and there are fears of homelessness of the families of the convicts and the exposure of their women to the danger of society." ".
    The legal expert also calls for "setting a cash allowance for the convicts who have been accused of financial corruption cases, which strengthens the economy and contributes to recovering the looted funds. Release of those who have served half of their sentence.
    And he warns that “the government and parliament have the right to exclude any category of pardon from the convicts for reasons estimated by the judicial authorities,” noting that “the pardon does not eliminate the element of the crime for the pardoned, and he is given a card after approving the pardon showing that he is pardoned due to the necessity of reforming him after he is forced to work in factories and factories.” And correctional and rehabilitative courses. As for foreigners who committed crimes in Iraq, they cannot be released except after taking special compensation from their countries and the damage they caused, as Libya did in the time of Gaddafi.”
