The Federal Office of Financial Supervision indicated that there is a weakness in the services provided to minors, while the Ministry of Justice indicated that the department deals with high professionalism in preserving their money.
An official source in the Diwan told Al-Sabah: The societal audit report indicated that Law No. 78 of 1980 was approved for the Department of Minor Care, as 43 years have passed since its issuance, followed by the issuance of some instructions and decisions without updating the law as a whole, pointing to Amending Articles (43 - Third and 73 - First) thereof, which are concerned with doubling the deterrent financial fines, but they were not at the required level to limit the commission of violations and protect the rights of minors, pointing out the lack of legal studies useful in developing the legal aspects of the department in line with the current circumstances.
He pointed out that the report monitored the lack of interest in the strategic plan of the Department of Minors' Welfare in social, cultural and educational aspects, in addition to the electronic link between the Department and government institutions such as the Ministries of Foreign Affairs, Education, Finance and others to facilitate and speed up transactions, stressing the lack of joint cooperation between the Department and civil society organizations, despite The effectiveness of the latter in providing technical, educational and cultural support, as well as the lack of cooperation with the relevant ministries such as the ministries of youth and sports, labor and social affairs and education, noting the role of the Ministry of Health in diagnosing incurable diseases for minor patients and including them in treatment outside Iraq.
The source indicated that the report disclosed that the investment of minors’ money was limited to fixed deposits, excluding other investment fields (real estate and securities) for the years 2020 and 2021, as the department did not invest in the field of real estate purchase despite the increase in the funds deposited with it, nor did it invest land for purposes allocated to it, and did not start developing banking alternatives to fixed deposits in the event that it did not agree with the bank on the interest rate, noting the continuation of dealing with the Rafidain Bank despite the fluctuation of the interest rate in it, which negatively affected the development of minors’ funds during those years, adding that the visits The fieldwork conducted by the audit team showed that the minors’ care directorates did not adhere to occupational safety and health procedures, as there are heating devices and electric wires visible inside the rooms for keeping files of minors’ transactions, which exposes them to burning or damage, and there are no central firefighting systems available.
The Bureau noted the scarcity of field visits by the social researcher for the minor to know his social, educational and cultural status due to the small number of social researchers, as well as the lack of places designated for people with special needs and the elderly within the department building and its formations, pointing to the insufficiency of the financial allocations granted to the minor, as a grant was disbursed (500) thousand dinars for all cases of minors that must be disbursed for one time, without taking into account their numbers within the same family, and without relying on controls, instructions, or conditions that clarify the circumstances and reasons for disbursement, which indicated the guardians’ dissatisfaction with the level of services provided by the Welfare Department.
The report urged the amendment and updating of the Minors Care Law in line with the changes taking place in society, and the preparation of a comprehensive strategic plan that contributes to the development of the work of the Minors Care Department, in addition to finding effective ways of joint cooperation with civil society organizations and relevant state institutions, and working to invest the lands belonging to the Department for purposes allocated from buying or selling them and investing their money in other fields, as well as obliging the department to apply safety procedures.
In turn, the spokesman for the Ministry of Justice, Kamel Amin, told Al-Sabah: Recording some observations on the work of the department is normal, but many of them are processed according to the flexibility of accounting systems and opinions in this aspect, indicating that the Department of Welfare of Minors' Funds deals with a high professionalism with a segment It is one of the rights of citizens, and it not only preserves the funds of minors, children and prisoners as they are incapacitated, but also develops them, by introducing them into safe and secure investments that do not have risk as they are funds that have legitimate credit, indicating that the department keeps pace with the daily needs of the minor and provides the payment process for him in a manner Continuing, whether it is for the purposes of treatment, buying a house, or improving his living situation, pointing to the adoption of a mechanism through the directorates to pay money when needed and maintain it.
He emphasized that the Ministry of Justice, the Minors Welfare Department and the Minors Welfare Council, which is chaired by the Minister of Justice and with the membership of the Ministries of Finance, Planning, the Real Estate Registration Department and other parties, are the decision makers in the process of entering investments and purchasing lands for the purpose of investing them, noting that the decision is not related to the ministry only, as usually Decisions are taken by vote.
