Government statement from Kurdistan: We cannot bear the failure of oil exports and must adhere to the January agreement

The Ministry of Natural Resources in the Kurdistan Regional Government confirmed today, Tuesday (April 23, 2024), that it does not bear responsibility for the failure of oil exports, calling on the Baghdad government to adhere to the January agreement and facilitate the resumption of exports.
The ministry said in a statement received by "Baghdad Today", that "the Kurdistan Regional Government is aware of the recent official statements issued by the Ministry of Oil in the Iraqi Federal Government regarding the export of oil from the Kurdistan Region," indicating that "these statements attempt to blame the Kurdistan Regional Government for the failure of... Oil exports: In particular, the Iraqi Oil Ministry says it “continues to insist on resuming exports via the Iraqi-Turkish pipeline as soon as possible, while adhering to the provisions of the constitution and the law.”
The statement added, "The legal basis for these oil contracts is the Oil and Gas Law issued by the Kurdistan Regional Government of 2007, which was unanimously approved by the Kurdistan Parliament. This 2007 law has been recognized by the world's leading constitutional and international lawyers as having a solid foundation in the constitution." Al-Iraqi for the year 2005,” pointing out that “among these lawyers is the late Professor James Crawford, one of the judges of the International Criminal Court, and more recently Judge Steven Schawbel, the former president of the International Criminal Court. Both lawyers have published their opinions, and these views have become the basis for all investments made.” Its total value amounts to hundreds of billions of dollars, a large percentage of which came from Western investors in Iraqi Kurdistan.
He continued, "On the other hand, the Iraqi Ministry of Oil relies only on a decision issued in February 2022 by a committee or group of political appointees in Baghdad, in which it was claimed that the Kurdistan Regional Government Law of 2007 is unconstitutional," noting that "it is clear that the Ministry of Oil Iraq does not even talk about the legitimacy of the committee. As expected, the “decision” of the political committee in February 2022 resembles the decisions of Saddam’s regime on which it was designed, without any basic legal understanding. It has become a disgrace to the Iraqi people.”
He stated that “the Presidency of the Kurdistan Regional Government revealed this clear fact immediately after the decision was issued, and the legislative and judicial authorities in the Kurdistan Regional Government later followed suit,” stressing that “the judicial authority in the Kurdistan Regional Government is properly formed, and does not recognize the decision issued on February 15.” 2022 as a court decision. In reality, the Iraqi government was unable, or unwilling, to pass any oil and gas laws.”
He pointed out that "the Iraqi government's oil sector is rife with corruption, excessive centralization, and a lack of legitimacy, and currently relies on outdated orders from Saddam Hussein's regime. The truth is that no Iraqi federal institution, including any court, has the ability to abolish... The 2005 Constitution or the laws of the Kurdistan Regional Government,” explaining that “in January of this year, two high-level delegations from the Kurdistan Regional Government and the Iraqi government met, without prejudice to our constitutional rights, and agreed on the provisions of the federal budget law that addresses technical issues related to the costs of Oil production in the Kurdistan region, and our mutual understanding was that the law would be implemented and exports would resume without further delay.”
The statement stressed, "We encourage the Iraqi government to adhere to the terms of the January agreement and facilitate the resumption of exports. There is no justification, neither in the 2005 Constitution nor anywhere else, for the Ministry of Commerce to impose barriers on oil exports. These exports are important for the well-being of all the Iraqi people." It is also vital to peace and energy security in the international community,” noting that “the Kurdistan Regional Government will continue to support and encourage law enforcement, and the Kurdistan Regional Government must protect the integrity, independence, and constitutional authority of the Kurdistan Regional Government’s courts.”
