The Australian authorities intend to return an Iraqi refugee to his country, despite acknowledging that he could be harmed or killed there, according to the " [You must be registered and logged in to see this link.] " newspaper .
The 27-year-old refugee was convicted of sexual assault in 2015 and spent 18 months in prison.
The refugee, whose initials "MNLR" was mentioned by the newspaper, arrived in Australia with his family in 2011, and he is from the Sabian community.
The newspaper indicates that the refugee's family was granted a humanitarian visa after being subjected to great persecution inside Iraq, as his sister was kidnapped, raped and killed, while other family members were threatened with abuse.
The newspaper adds that an Australian government lawyer said earlier that Sydney was ready to defy international law and return the refugee to his country of origin despite the fact that it had signed the Refugee Convention that prohibits refoulement.
The authorities canceled the refugee's visa in preparation for his deportation, but he lodged an appeal with the court, which found that he would be at real risk of harm if returned to Iraq and that Australia was legally obligated not to return him.
The court pointed out that the latest report issued by the Ministry of Foreign Affairs and Trade on Iraq "indicates that there have been kidnappings of Sabean Mandaeans in order to obtain ransom, with a high risk of being killed because of their refusal to pay."
However, the court refused to revoke the government's decision to end the refugee's visa, which means that he will remain in detention indefinitely until the decision to deport him is decided, according to his lawyer.
