Today, Saturday, the legal expert, Tariq Harb, clarified the fate of tomorrow's Federal Court decision to challenge the results of the legislative elections.
Harb said, in a post on Facebook, that "the first session, which will be chaired by the eldest of the winners, i.e. the oldest member of the new parliament, will be devoted to taking the winners the constitutional oath, and in this the winners will turn into deputies of members of the parliament in its new session and elect the speaker of the parliament in the first session considering his election." It is the first job position required by the constitution to be elected, whereby the elected head of the parliament takes over, after which the door for candidacy for the position of President of the Republic is opened.
He added: “Someone might say what is the result of the lawsuit and the appeal that includes the cancellation of the electoral results. We say that they will be answered and rejected by the court, because the evidence presented does not rise to the level of taking a dangerous ruling, such as the ruling to cancel the electoral results of the constitutional provisions that contradict the lawsuit and the request and do not support it.”
Harb continued, that there are "serious effects on the cancellation of the vote and the will of millions of people who voted and the absence of a parliament that takes on the difficult electoral task in the event of the results being canceled, especially since the court ruled to invalidate the lawsuit to restore the previous parliament, which was instituted by the Bar Association and a number of former MPs and Basem Khashan."
And the legal expert added, "A special reason that necessitates urgency in setting an early date in the president's decree is the delay in ratification this year for the previous election years, which did not take only four days, and the delay in ratification was due to the lawsuit and appeals that requested annulment of the electoral results."
And he continued by saying: “It is natural that the date of the ruling that had to be issued on Sunday 12/26 is postponed by virtue of the pleadings law to the working day that follows the holiday. Therefore, the ruling of the Supreme Court will be on Monday 12/27 and not Sunday 12/26 due to the coincidence of the holiday.”
Harb concluded by saying: "The rulings of the judiciary and the rulings of the Supreme Court remain a title of justice, truth and law, whatever the type of ruling. It is superfluous to the constitution that the ruling of the Federal Supreme Court is binding on all state authorities, final and final."
