    [size=45]Hussein al-Haj Hamad, a researcher in constitutional law, said, “Provincial council elections represent a constitutional and practical necessity at the same time, as the Iraqi constitution of 2005 adopted administrative decentralization, and established provincial councils to represent the popular base of the province, to monitor the work of the governor and government departments in the province.”[/size]
    [size=45]Hamad added, “The constitution explicitly provides for the election of the provincial council, meaning that the formation of the provincial council can only be by election, and also the court has completed this principle and obligated that the elections be held within specific time periods, so that the parliament may not prolong this period.” .[/size]
    [size=45]And he continued, “The practical reality necessitates the establishment of provincial councils, especially after the formation of the new government and its ministerial platform, which emphasized a number of issues, including the issue of reconstruction and the completion of previous projects, which necessitates the existence of popular oversight over these actions represented by the provincial council.”[/size]
    [size=45]He explained, “Despite the existence of this necessity, there remain some obstacles that prevent the holding of provincial elections. There must be a political will that agrees to set the date for the elections, and this agreement precedes the existence of an election law that takes into account the political and legal changes that occurred in the country. Especially after the change in Parliament Elections Law No. 9 of 2020.”[/size]
