    Baghdad/Al-Masala Al-Hadath: The Federal Court of Cassation’s decision to reject the Federal Court’s decision to amend the text of the Retirement Law sparked widespread controversy over the constitutionality of this decision and the soundness of the legal procedures followed.
    According to a high-ranking judicial source, the decision of the Federal Court of Cassation either constitutes a major violation of the Iraqi constitution, or it means that there is no constitution in the country at all.
    In 2019, the Iraqi Council of Representatives made an amendment to the Unified Retirement Law No. (9) of 2014. Article 10 of the amended law stipulates that an employee be referred to retirement upon completion of (60) years of age, which is the legal age for referral to retirement regardless of age.     This amendment sparked widespread controversy and a movement to amend the retirement law regarding pensions and retirement ages. The Federal Supreme Court later intervened and issued a decision regarding this amendment.
    But in a surprising move, the Federal Court of Cassation decided to reject the Federal Court’s decision to amend the text of the retirement law, which raised a legal storm and doubts about the constitutionality of this decision and the credibility of the country’s judicial system.
    Judicial sources warn that this decision either constitutes a flagrant violation of the Iraqi constitution, or it means that there is no constitution in the country at all, which threatens to destabilize the legal and constitutional stability in Iraq.
