Constitutional vacuum in the provinces enters its third week

     Baghdad / Mohammad Sabah

Parliamentary Legal Committee revealed the completion of the amendment of local elections law, noting that the final draft will allow the continuation of the provincial councils until the election of new local governments.
And exclude the Committee of the Regions and the provinces to resolve the legal and constitutional crisis for provincial councils in the coming sessions, attributed to the concern of the Parliament to dismiss the election commission.
In parallel, 200 deputies submitted a request to the Presidency of the parliament to issue a formula under which freezes the work of the provincial councils, that the House of Representatives is responsible for managing the affairs of the provinces instead of their boards , which ended the legal mandate on the twentieth of the month of April.
Says MP Zainab Sahlani, a member of the Liberal parliamentary bloc in a statement (term), "There is a request submitted to the Presidency of the Council of Representatives holds the signatures of a large number of MPs to freeze the provincial councils and the abolition of district councils and districts," noting that "this request came Ptbn from by MP from the coalition of state law Riad Ghraib. "
The MP for the Liberal parliamentary bloc Riad Ghali Saadi, announced last week to collect the signatures of 200 deputies to stop the work of the provincial councils, pointing out that any decisions issued by these councils are considered "illegal".
Since the date of the 20th of last April, the local government entered into a constitutional vacuum due to the end of the mandate of the councils. The House of Representatives stands bewildered to address this vacuum witnessed by the provinces for the first time since its inception in 2003.
Although determining the next September as the date for local elections, but the political, legal and logistical data preclude local voting in its history.
As a director and a legal constitutional vacuum, parliamentary parties to propose a resolution of the House of Representatives can manage provincial affairs rather than local councils.
The ultra - MP Sheikh Ali, a member of the Legal Committee, has revealed (range), recently, that " the House of Representatives is preparing to issue a formula decision to grant him the right to provide for the management of provincial affairs rather than local councils , which ended the legal duration of the twentieth of the month of April."
In this context, MP Sahlani reveals "the existence of several options on the table before the House of Representatives pour all in the extension of the work of the provincial councils until the election of new local governments." He explains a member of the Liberal bloc that "these options is the legal amendment provincial councils elections No. (21) and incorporate them article stating the continuation of these councils."
However , the continuing differences between the components of Kirkuk would disrupt the provincial elections law, as calling for parties to conduct local elections with the rest of the provinces according to the mechanism provided for by the government draft of the law of local elections, and against the parties that call for the province of Kirkuk a special status.
She member of the Legal Committee by saying that " the local elections law is ready and fully and was sent by the legal representative to the Presidency of the Council of Representatives , including a clause allowing provincial councils to continue their work." She stressed that " the request signed by a number of deputies to the freezing of the provincial councils came to the Presidency of the parliament."
In this regard , stresses the Committee of the Regions and provinces parliamentary that "it is up to the Presidency of the Council of Representatives to view this request in the next House of Representatives sessions", expected that the parliament approved a decision soon to merge the local government elections with parliamentary and as well as the continuation of the work of the provincial councils to next April.
Under Articles (4-6) of the provincial elections , the applicable law, that " the electoral cycle councils for four calendar years, starting with the first hearing will . And end membership automatically after completion of the four calendar years commencing on the ratification of the election results."
According to a member of the Messenger of Abu Hasna, in a statement (term), " The problem of Kirkuk would hinder the adoption of the local elections law, after it became ready to vote", ruling out the solution to the provincial crisis in the coming sessions due to the preoccupation of parliament in the dismissal of the election commission or not.
It refers MP from the coalition of state law that "voting on this law by the House of Representatives will give a mandate to the Council of Ministers and the Electoral Commission to announce the integration of the elections and extend the work of the provincial councils."
Article (46 / I) of the influential provincial elections law in 2013 that " the election date to be determined by the Council of Ministers upon the proposal of the Commission to be announced by means of various media before the deadline for the vote for 60 days."
Paragraph III of the same article that "in the case of the postponement of the elections and the provincial and district councils continue to manage its affairs until the election of new councils."
And select Prime Minister Haider al - Abadi, the beginning of this year, the date of the 16th of September next date for provincial elections across the country.
The suspended MP from the Kurdistan Islamic Group Bloc Zana happy to enter the local governments in a constitutional vacuum after the end of the mandate of the councils by saying that " the best solution to the problem of local governments depends on the legislation of the provincial elections law this week," adding that "this law includes in one of its articles continued the work of local governments while choosing new local councils. "
Said refers, in connection with (range), that " the demands of the Turkmen would block the vote on the provincial elections law , " likely " to pass this law in the meetings this week or before the legislative term holiday."
