    Baghdad / Obelisk: A statement by the office of the Iraqi Prime Minister, Muhammad Shayaa al-Sudani, said, on February 8, that the government advisor for constitutional amendments presented to the President of the Republic, Abdul Latif Rashid, the government's draft for constitutional amendments in order to coordinate with other authorities, including Parliament and the Supreme Judicial Council. .
    It is hoped that the amendments will define the constitutional provisions that have created political problems in the country during the past 18 years.
    However, it is expected that the constitutional amendments will not pass easily due to the rejection of them by many political forces.
    The sources talked about an agreement between the Iraqi political forces on the constitutional amendments, and a discrepancy about the nature of those amendments and the materials targeted in them, which is considered the biggest obstacle to proceeding with them.
    The Iraqi constitution requires for any amendments to be made the proposal of the President of the Republic and the Council of Ministers jointly to make this amendment, or a request submitted by one-fifth of the members of Parliament (the number of members of Parliament is 329). Article 126 of the Iraqi constitution stated that the amendment takes place after the majority of parliamentarians vote on the amendments, and then submit it to a popular referendum. Amendments are considered approved if they are not rejected by two-thirds of the population of three governorates.
    The amendments require political consensus through a popular referendum, and in the event that three governorates reject this referendum, this means that no change will take place, and before that there must be a political agreement on them.
    And the legal expert, Ali Al-Tamimi, explained the possibility of proceeding with constitutional amendments, saying that they require long procedures.
    Al-Tamimi said, “The Iraqi constitution is one of the rigid and not flexible constitutions, that is, it cannot be amended except through long procedures.”
    And the legal expert stated that “Parliament must form the amendment committee, and first approve its amendments with a majority of its members (half of the total number + 1), after achieving the quorum, and then present the amendments to a popular referendum and approve half of the voters + 1, and not object to The amendment is two-thirds of the voters in 3 Iraqi governorates.
    Al-Tamimi pointed out that "the articles that need to be amended are summarized in the form of the political system, as it needs a transformation to the presidential system that is best for Iraq, and the dissolution of Article 140 related to the disputed areas and Article 73 related to the powers of the president and the form of parliament," and he believed that the form of the political system is possible. To be mixed, as in France, that is, the president is elected by the people and the prime minister is elected by parliament, and the powers of the president are greater.
    And the Iraqi constitution was approved in 2005, in a popular referendum that was boycotted by a wide spectrum of Iraqis. The constitution includes clauses and paragraphs that are still controversial, starting from the first preamble to the constitution, which replaced the phrase that Iraq is an Arab country, which has existed since the founding of the modern Iraqi state, to the phrase that Iraq is a multinational, religious and sectarian country and a founding and effective member of the League of Arab States, passing through the disputed territories article. on her.
    Lawyer Ali Adnan al-Sharifi stated that the amendment of any article of the constitution can only be done with the approval of the Iraqi people in a general referendum, and this article was voted on by the Iraqis in the 2005 referendum, and amending the constitution is not an easy thing, considering that the constitution of Iraq is one of the rigid constitutions in constitutional jurisprudence.
    The expected amendments include determining the largest bloc that wins the elections, which is concerned with the formation of the government, the administration, the sharing and distribution of oil wealth, and the relationship of the regions with the federal government.
    The government can propose amendments, or the deputies agree to form a committee to amend the articles of the constitution.
    In 2019, the Iraqi Council of Representatives formed a committee to amend the constitution against the backdrop of popular protests, but the committee did not make any progress towards the amendments, due to a political rejection of that.
    In an indication of the importance of the amendment, the Iraqi Prime Minister, Muhammad Shia' al-Sudani, and the leader of the National Coalition, Iyad Allawi, discussed the national dialogue initiative to amend the articles of the constitution.
    The leader in the framework, Mahmoud al-Hayani, admits that the amendment of some paragraphs of the Iraqi constitution will lead to political differences, pointing out that there is a division of views on the amendments, which means objection to the move of the Iraqi Prime Minister Muhammad Shia al-Sudani in this regard.
    He said, “Amending some constitutional clauses requires political consensus, and frankly, there is no political consensus in this regard, as there are many differences over the amendments of some constitutional clauses.”
    The academic, Dr. Sattar Al-Jabri, talks about the veto of three Iraqi provinces on any amendment, and in light of intense political tension and tense relations between the center and the region, any amendment seems impossible, and all that is involved is the granting of consolation positions to certain people and parties.
