The Electoral Commission enters the stage of "business conduct" after the end of its mandate

     Baghdad / Mohammed Sabah

A day after the end of its legal mandate, opinions within the EC's leadership team differ on the legal status of the current Board of Commissioners. While the President of the Council confirms the legitimacy of the Council until the next three days, another official recognizes the end of the legal mandate.
Although officials disagreed, they agreed to extend the parliament's work for a month, a senior deputy denied.
In the meantime, an expert on electoral affairs confirms that the Commission entered the stage of "conduct of business" for the end of its jurisdiction. The expert confirms that the Commission from now on is unable to ratify the political entities or grant the parties licenses establishment, and is prohibited from any activity that has a financial impact.
The legal mandate of the Electoral Commission ended on Wednesday without parliamentary blocs succeeding in choosing an alternative, given the complexity of differences over the alternative.
And failed attempts by the Presidency of the House of Representatives, during a meeting Tuesday, with the large blocs, after she wished to pass the nine candidates of the Committee of Experts, in a session witnessed verbal arguments ended with the withdrawal of 60 deputies from the Hall.
The House of Representatives was unable to extend the work of the Council of the current Electoral Commission due to the imbalance of the quorum and the objection of many blocks, a decision to adjourn the meeting to the day of 25 September.
"The Diwaniyah, the deputies and the section were on 23/9/2012, and therefore the current council will have a period of three days after the end of its legal session specified in the law of the Electoral Commission, five years," said Srebast Mustafa, head of the Commission.
The Chairman of the Council of the Commission, in a statement to (the extent) yesterday, that "the Commission will continue in its daily work in this period remaining normally," pointing out that "the House of Representatives will resolve all differences in the coming sessions." "The House of Representatives extended the work of the Commission for one month, which enables the current Council to conduct its daily work," Srebst Mustafa insisted.
The deputies have denied, in a statement to (the extent) that the Parliament has extended to the Electoral Commission during the hearing on Tuesday, which saw the withdrawal of a number of blocs and deputies opposed to pass candidates of the Committee of Experts.
The deputies stressed that the disruption of the quorum prevented the amendment of the law of the Commission or vote on the nine candidates, in addition to the extension of the current commission.
The Speaker of the House of Representatives has presented, during Tuesday's session, the options in the event of the failure of Parliament to choose a replacement for the current Commission, and offer extension as one of the options put forward.
In turn, Mekdad al-Sherifi, spokesman for the Electoral Commission, the current mandate of the Board of Commissioners is over. "We expect the House of Representatives to vote on the selection of the new Council of the Commission."
Al-Sharifi said in a statement to Al-Mada yesterday that "all the members of the Board of Commissioners completed the books of innocence and it is up to the House of Representatives." But Sharifi agrees with Serbst Mustafa that "the parliament extended the work of the Board of Commission for a month full."
Al-Shuraifi expressed concern over the question of the legal status of the Board of Commissioners. Refusing to give a clear answer.
The political deal concluded by the blocks with the leader of the Sadrist movement prevented the overthrow of the Electoral Commission after the parliament's vote not to be satisfied with the answers to the recent interrogation by one of the deputies of the Liberal bloc.

Al-Ahrar bloc, the main opposition to the quota, participated in the committee of experts in charge of selecting a new council for the commission. The leaks obtained by Al-Mada recently confirmed that the Sadrist bloc won one seat out of 9 seats.
In the same context, denied the MP Alla Talabani extension of the current Council of the Commission. Talabani said in a statement to Al-Mada yesterday that "persistence of stubbornness by some political parties will push us to extend the work of the Electoral Commission during the coming sessions to a full month until a consensus is reached between the blocs."
A member of the Patriotic Union of Kurdistan bloc "during the next session we will present the option related to the results of the Committee of Experts, and the judicial supervision of the vote to choose one and proceed to solve the problem."
Adel al-Lami, a former official in the Electoral Commission, describes the current work of the Commission's board as "illegal" and a violation of the general administrative law governing the general rules of officials who are assigned to administer positions and positions for a specified period.
"From the date of 20 September, according to the General Administrative Law, members of the Electoral Commission are not entitled to any salary, and they are not entitled to carry out any work that has a material or financial impact after they have completed five years In their posts ".
"If the parliament extended to the Commission, the date of the extension will be from September 20 and for a month," the former official said. "The current period is all calculated within the period in case parliament extends the work to it."
The expert in the electoral affairs that "all the departments related to the Electoral Commission will exercise its normal work because its cadres of staff, but the Council of Commissioners can not ratify the political entities or give the parties licenses establishment."
"The current work of the Commission is like conducting business, and is limited to monitoring only, and it is not entitled to carry out any administrative action that has a material or financial impact," Lami said.
