: Thursday, 31/01/2013 02:48 pm BAGHDAD - A citizen Date: January 31, 2013 The Cabinet decided at its regular fourth session held on Tuesday, January 29, 2013, to approve the issuance of a document leave subsequent negotiation and signing of the Minister of Transport on the draft agreement on the organization of maritime navigation in the Khawr Abd Allah between Iraq and Kuwait based on the provisions of articles (6 and 28) of the Law of Treaties No. (111) of 1979 amended with the Foreign Ministry to prepare a document leave subsequent behalf of the Government of the Republic of Iraq to the Minister of Transport in accordance with contexts approved for submission to the General Secretariat of the Council of Ministers for obtaining the signature of the President of the Council of Ministers as well as the approval of the draft law on ratification of the said Convention and forwarded to the House of Representatives based on to the provisions of articles (61 / I and item 80 / item II) of the Constitution |

Baghdad (IraqiNews.com) -MP, Aliya Nusayif, of the Hurra Iraqiya bloc described the agreement conducting by the Iraqi government over organizing the navigation in Khor Abd Allah as “Illegitimate.”
In a press statement received by IraqiNews.com, she said “The agreement was conducted with the Kuwait side over organizing the navigation in Khor Abd Allah was done by the joint committee or the Secretariat of the Council of Ministers, is illegitimate without submitting it to the parliament and the Ministry of Transportation,” noting that “The parliament may reject it because it is considered as a formal organization in Mubarak port.”
“All know that Mubarak port effects Iraq as the MoT warned so many times from this effect,” she pointed out, assuring that “Such agreement is illegitimate and it is a clear recognition in Mubarak port.”

The Council of Ministers decision approving a draft Convention for the regulation of marine navigation in the Khawr Abd Allah waterway between Iraq and Kuwait.
And the Council of Ministers said in a statement faxed to all Iraq [where] a copy of it on Thursday "that the Board approved at its fourth ordinary meeting, on Tuesday, 29 January 2013, to issue a subsequent leave the negotiation and signature of the Minister of transport on the draft Convention on the regulation of marine navigation in the Khawr Abd Allah waterway between Iraq and Kuwait on the basis of the provisions of articles [1-28] of the law of treaties No. [111] of 1979 as amended with the Ministry of Foreign Affairs prepared a document subsequent confirmation on behalf of the Government of the Republic of Iraq to the Minister of transport in accordance with the approved contexts To the General Secretariat of the Council of Ministers in order to obtain the signature of the Prime Minister and approval of the draft law of ratification of the said Convention and referred it to the House of representatives on the basis of the provisions of articles [16/item first and 80/item II] of the Constitution. "
A Government spokesman said from within the Council to approve the draft law on ratification of the Convention on the regulation of marine navigation in the Khawr Abd Allah comes in from the Iraqi Government to strengthen the bilateral relationship between the two countries, and respect the rights of passage through maritime headquarters in international covenants and conventions and maritime transport sector support through the Organization of maritime traffic in the Khawr Abd Allah, a joint Commission working to operationalize and implement the terms of this agreement and joint plans for maritime safety in the Khawr Abd Allah and other navigational and environmental issues ".
"The Ministry of Foreign Affairs requested on 7 January 2013 from the Cabinet approval of the draft law on the Convention and the draft law of ratification and Legal Department of the General Secretariat of the Council of Ministers on 14 January 2013 view subject to Council and Iraqi Foreign Ministry explained the actions taken by the Kuwaiti side on the Convention with a presentation to Cabinet work continues on an urgent basis for presentation to Parliament.
The Government spokesman said that the agreement had provided for not raising any flag for ships carrying the nationality of one of the Contracting Parties is not aware nationality during transit in the territorial waters of the other party when the exercise of navigational passage either foreign vessels they will raise the flag of nationality only and the provisions of this Convention shall not apply to the passage of warships and Coast Guard for both parties where each party will work to prevent fishermen from being in part in its territorial sea from the fairway will work to maintain Of the marine environment from pollution risks whatsoever and to combat and ditch ".
