[rtl]Baghdad / NINA / The Parliamentary Legal Committee revealed the clothes of the pending political differences in the controversial Federal Court Law, while the Parliament officially voted on two versions, one of the draft law and the other of the proposal to amend it.
A member of the committee, Deputy Saeb Khadr, stated in a statement to the Iraqi National News Agency / NINA / that "the dispute over approving the Federal Court law is still present, and there are two main axes regarding the issue of forming the Federal Court, one of which relates to the draft Federal Court law that came in accordance with the text of Article 92 of the Constitution. That a new law is enacted for the court, so we proceeded to vote on the articles of the bill successively, with the exception of the controversial articles 2-3-12.
He explained, "The draft law includes the description and specification of experts and Sharia scholars, their role in the court, and the mechanisms for voting on court decisions."
He added: "There is a difference of views between the representatives of the components and their political orientations, the first of which are reservations by some blocs regarding the mechanisms for voting on the decisions of the Federal Court," noting that "some parties insist on achieving consensus in court decisions by the nine judges, and others believe that it is necessary to vote." Six out of nine in decisions related to constitutional issues within the jurisdiction of the court, and other parties see the adoption of the vote of seven out of nine judges in the court, but so far this complex has not occurred. "
"The other reservation relates to the presence of Sharia jurists and their competence in the court and the voting mechanisms on its decisions," he said, referring to the reservations of minority representatives on the draft law and the presence of the jurists, which prompted them to submit a formal request for the role of jurists to be advisory only, which is not included in the draft law.
A member of the Legal Committee asserted that: "In light of these reservations, the House of Representatives proceeded to present a proposal to amend Order No. 30 of 2005 of the Federal Court Law, which was discussed and voted on in the Monday morning session."
He explained that "Parliament now has two copies officially voted on, the first is for the new draft law with reservations on the remaining three articles, and another copy for the amendment proposal with reservations as well," indicating: "There is a sharp legal debate about which one to proceed with, is it the bill. Which includes specifying the jurists and experts and their powers, or the proposal to amend Ordinance No. 30 of 2005, which does not include reference to jurists and experts, but only addresses vacancies in the quorum of members of the Federal Court to start its work as it was previously.[/rtl]
