Baghdad / Muhammad Sabah
Once again, influential parliamentary blocs began to talk about the possibility of changing the date of the early parliamentary elections, scheduled to take place on the tenth of next October, and said that accepting their appeals by the Federal Court on the ballot law will change the operational schedules of the commission and its logistical preparations.
Bahaa al-Din Nuri, spokesman for the State of Law Coalition for (Al-Mada), confirms that many parliamentary blocs have submitted their appeals to the House of Representatives election law before the Federal Court, indicating that those political parties have proven many violations, irregularities and observations on the passage of this law within the House of Representatives.
On the 27th of last March, (Al-Mada) revealed the intention of various parliamentary blocs to make amendments to more than twenty articles in the Parliamentary Elections Law, among the most prominent of these appeals are the cancellation of the multiple departments, the biometric card, the foreign vote, and the lifting of the criminal registration penalty for some personalities.
Nuri added, "The appeals were submitted after the election law was enacted and the electoral districts passed, but the Federal Court at the time did not rule on them due to the lack of a quorum." The MP from Maysan Governorate shows that “the State of Law and National Approach Coalition (Virtue Party) submitted their appeals to the Federal Court on some paragraphs and articles in the Parliamentary Elections Law,” indicating that “our bloc had no desire to pass the small circles and expressed its objection and withdrew from the voting session. That time". Last year, the House of Representatives completed voting on electoral districts in the new legislative elections law, which divides the provinces into 83 multiple electoral districts in which the candidacy is individual, in response to the demands of the popular movement.
The government postponed holding parliamentary elections until October 10, 2021, after the Commission proposed to postpone the parliamentary elections in order to “complete the technical aspects of registering political parties, distributing electoral cards, and ensuring international monitoring.”
The deputy points out that “the appeals were based on legal issues and indicators and on this basis were submitted to the Federal Court,” indicating that what we aim to do is to ensure the participation and competition of all emerging parties in early parliamentary elections without exclusion. Earlier, Imad Youhanna, advisor to the Speaker of Parliament for Component Affairs, said in a statement to (the extent) that "there is a parliamentary approach to amend the parliamentary election law during the coming periods, including the cancellation of voting abroad by the Commission."
The Election Commission attributed the decision to cancel the voting of citizens living abroad in the early parliamentary elections to the difficulty of registering voters abroad by biometric (electronically) during the remaining period of the completion of the registration process, which is only 40 days, as well as the Ministry of Foreign Affairs’s apology for conducting polling in Iraqi embassies and consulates due to the impossibility of holding them in The current stage.
For his part, Mazen Al-Faily, a representative of the National Approach bloc, considers in a statement to (Al-Mada) that filing an appeal before the Federal Court is natural, as it is specialized in the process of ruling on the constitutionality of laws or not, stressing that any person or entity has the right to file appeals against laws before the court.
Among the competencies of the Federal Court drawn up by the constitution in its Article (93) “overseeing the constitutionality of laws and regulations in force, interpretation of the provisions of the constitution, adjudication of cases that arise from the application of federal laws, decisions, regulations, instructions, etc., and adjudication of disputes that arise between the government and the governments of regions and governorates.”
Al-Faili explains that “the National Approach bloc did not submit any challenge to the Parliamentary Elections Law before the Federal Court, but we had objections to the law, including the lack of a population census, as well as the overlap between districts and sub-districts, as well as the geographical contiguity by joining some districts to districts with a large population. “. He believes that "in the event that there are appeals on essential articles such as Article (15 and 16) and are accepted by the Federal Court, then they will be amended by a law and it needs a first and second reading, and then a vote, and this affects the willingness, timing and plans of the Electoral Commission."
The deputy from Wasit Governorate expects that "many parliamentary blocs will submit appeals to the Parliamentary Elections Law," noting that he does not know anything and details about the names of these blocs that intend to challenge this law before the Federal Court.
