The Human Rights Committee in the House of Representatives announced the inclusion of the general amnesty law on the agenda of the upcoming sessions of Parliament.
Committee member Nissan Al-Zayer told Al-Sabah: The general amnesty law has reached the Legal Committee, noting that Parliament Speaker Muhammad Al-Halbousi signed a book that includes putting it forward for first reading in the nearest parliamentary session.
She indicated that everyone is seeking its approval because it will ease the burden on the government, in addition to enabling the security services to release innocent people in prisons.
For his part, legal expert Ali Al-Tamimi explained to Al-Sabah that the general amnesty law can provide justice to large groups and contribute to strengthening societal peace, in addition to increasing citizen confidence in the government and saving a large segment of those who are languishing in prisons for reasons, some of which may be force majeure circumstances beyond the control of the government. Al-Tamimi added that, according to a realistic legal point of view devoid of emotion, the government’s acceleration in submitting the draft general amnesty law to Parliament has become an urgent necessity due to several factors and reasons, including the overcrowding of prisons with convicts in light of the risks of the survival of coronavirus variants, pointing out that Article 2 of the World Health Agreement indicated the necessity of Saving these segments from epidemics, especially since the Health Organization ranked Iraq 20th internationally in terms of infections and deaths, and it is necessary to pass the law.
Al-Tamimi explained that reformist governments in all countries of the world are seeking to approve general amnesty laws to start a new page with the people who suffered from the scourges and accumulations of previous governments, noting that man-made laws have undertaken the task of general amnesty, such as the Iraqi Penal Code No. 111 of 1969 with Articles 150 and 153 and the Code of Procedure. Penal Code No. 23 of 1971, Articles 300, 301, 304, and 305.
He pointed out the increase in the costs of prisoners, including feeding, treatment, electricity, and water, in light of the rise in the price of the dollar, which costs the state budget huge sums. He pointed out that many parliamentary and governmental circles have pointed out suspicions of corruption in prisons, and with the approval of the pardon, these suspicions and suspicions will disappear.
Al-Tamimi stressed the need to release those who have served half their sentence, in addition to the fact that the government and Parliament have the right to exclude any category of convicts from amnesty for reasons determined by the judicial authorities.
He explained that the pardon does not eliminate the element of the crime for the pardoned person, but rather he is given a card after the pardon is approved showing that he is pardoned due to the necessity of reforming him later and putting him in correctional and rehabilitation courses, pointing out that foreigners who committed crimes in Iraq cannot be released except after receiving special compensation from their countries.
