    Today, Wednesday, the Cabinet Secretariat announced the controls for changing the gender of lands from agricultural to residential.
    And the secretariat said in a statement, "The Council of Ministers approved, in its eighth regular session, held on 21/2/2023, the controls for implementing the Cabinet Resolution (320 of 2022), regarding changing the gender of lands from agricultural to residential."
    The statement added, “The decision explained, in its first paragraph, a set of expressions related to the implementation of the aforementioned cabinet decision, as follows:
    1- State-owned lands, which are (orchards and lands owned by all official authorities affiliated with the state, including the Ministry of Finance, and lands of self-financed state institutions that carry out economic activity by producing Goods or services, dealing on economic bases, which are managed and funded by the state, including public companies
    2- Public benefit projects, which are projects dedicated to non-profit public services, such as (police stations, fire stations, hospitals, schools, places of worship, and water stations , sewage stations, etc.) 
    Second: The provisions of this decision include lands located within the limits of the basic design. 
    Third: The lands covered by the provisions of this decision are:
     1. State-owned lands. 
    2. Lands encumbered with disposal rights, after conducting the following: 
    a. Directing the dissolution committees concerned with the procedures for dissolving lands burdened with disposal rights and assigning them to the Municipality of Baghdad and the municipalities.
     B. The ownership of the Municipality of Baghdad and the municipalities of the lands indicated in Paragraph (2/a) mentioned above to the beneficiaries of the provisions of this decision after their allocation.
    Fourth: The provisions of the decision do not include lands allocated for public benefit projects. 
    Fifth: The approval of the Mayor of Baghdad and the governors of the minutes of ownership.
    Sixth: 
    1- The applicant for ownership shall submit an application that includes specifying (the name of the governorate, city, district, district, and residential neighborhood) to the concerned municipality directorate within a period not exceeding (90) working days, starting from the date of issuance of Cabinet Resolution (320 of 2022).
    2- The concerned municipality shall refer the application to the inventory committees and estimation committees formed under Law No. (21 of 2013) of Sale and Lease of State Funds and its instructions.
    Seventh:
    1. Inventory committees shall be formed in each administrative unit headed by the head of the administrative unit and the membership of the municipality director and the representative of the State Real Estate Department in the administrative unit. The committee may seek the assistance of a technical employee from the Real Estate Registration Department in which the real estate is located within its business area.
    2. The committees prepare an inventory of their actual beneficiaries supported by official documents, and it is submitted to the dissolution committees indicated in item (Third / 2 / A) of these controls.
    3- In the event that the committee finds areas that are less than the minimum limits for excretion, it proposes merging more than one property, to reach the limit permitted by law, and recommends issuing a real estate deed in a common way for applicants to own the merged real estate. 
    Eighth: The provisions of Legislative Decree No. (120 of 1982) are applied to those covered by these controls. 
    Ninth: Estimation committees are formed in accordance with the Law of Sale and Lease of State Funds (21 of 2013). 
    Tenth: The competent minister or the head of an entity not affiliated with a ministry, or whoever is authorized by either of them, may request the estimation committee to re-estimate if he finds it inappropriate and that it did not take into account the estimation bases written in the law. 
    Eleventh: The competent minister or the head of the entity not affiliated with the Ministry has the right to approve the ownership request and the allowance set by the estimation committees, based on the tables prepared by the inventory committee.
    Twelfth: The Real Estate Registration Department begins the procedures for transferring ownership in accordance with the law, after issuing the decision approving ownership.
    Thirteenth: The approval of the Minister of Finance on these controls is considered an exercise of his powers indicated under the provisions of the Law on the Sale and Lease of State Funds (21 of 2013) in approving the transfer of ownership of lands covered by the provisions of this decision, and the relevant ministry departments must complete the procedures for transferring ownership and selling procedures without the need to obtain The approval of the Minister of Finance again on the sale.
    Fourteenth: A committee shall be formed headed by a representative of the Council of Advisors, and the membership of representatives of the Ministry of Finance / State Real Estate Department, the Ministry of Agriculture / Director General of the Agricultural Lands Department, Baghdad Governorate / Director of Municipalities, and the Municipality of Baghdad / Assistant Director General of Designs, to answer the questions and inquiries of the Municipality. Baghdad and the provinces related to agricultural lands.
