Baghdad / Muhammad Sabah
More than fifty political figures are threatened with deportation and deprivation from running in the midst of the upcoming parliamentary elections scheduled for next October, after they were convicted of financial and administrative corruption files and various criminal cases.
The decision is likely to include current and former deputies and governors, current and former ministers, deputy ministers, and heads of a number of independent bodies.
In the year 2019, the Supreme Judicial Council demanded a statement to lift the immunity of (21) deputies accused of administrative corruption during their tenure in executive positions.
Article 63 / Second of the Federal Constitution regulates the granting of legal immunity and lifting it from the representative. Paragraph (b) prohibits the arrest of a member during the period of the legislative term, unless he is accused of a felony and with the approval of the members by the majority. Immunity with the approval of the Speaker of Parliament. Yonadam Kanna, head of the Al-Rafidain Parliamentary Bloc, stated in a statement to Al-Mada that “deciding on requests to lift the immunity of fifteen deputies is left to the Presidency of Parliament,” considering that “some of these lawsuits filed against MPs are malicious and scheming.”
Kanna adds that "no one knows when these requests will be presented to the House of Representatives for a decision, since the matter, as we said, is left to the estimates of the Parliament Presidency," pointing out that "some MPs faced these accusations and decided the matter in their favor judicially." The charges brought by the judiciary are divided into (21) deputies between cases related to financial and administrative corruption, and the second section relates to the existence of cases filed against a group of deputies accusing them of belonging to armed groups, and a third section falls under the issues of clan disputes and conflicts. The Public Prosecutor recently sent a letter to Parliament to lift the immunity of MP Karim Aftan, indicating that the reasons for lifting the immunity fall within a corruption case related to the Anbar gas station contracts. The head of the Al-Rafidain Parliamentary Bloc affirms that “many of the charges and cases directed against some parliamentarians have ended after a judicial decision.” He expected that “the coming periods will witness numerous accusations directed against many politicians with the intention of preventing them from participating in the parliamentary elections.”
The House of Representatives, in its previous session, had lifted the immunity of a group of its deputies after accusations made by Defense Minister Khaled Al-Obeidi of their involvement in corruption deals in his ministry, including the former parliament speaker who dropped all charges against him.
Rahim al-Aboudi, a member of the General Authority for the Wisdom Movement, stated in a statement to (Al-Mada) that "there are more than fifty political figures who will be deprived of participating in the early parliamentary elections scheduled for next October." Many positions in the Iraqi state.
In a previous statement to (Al-Mada), Deputy Chairman of the Legal Committee in the House of Representatives Muhammad Al-Ghazi stated that "the number of requests to lift the immunity of MPs and bring them in by the judiciary amounts to nearly sixty requests distributed among cases of defamation, slander and corruption." In the past, these requests were referred to the legal advisors. Al-Aboudi added, "The decision to deprive them comes after they were convicted of corruption, waste of public money and various criminal cases, as well as including some of them with accountability and justice procedures after they had, in previous periods, obtained exemptions from former prime ministers from these procedures." The previous parliament had received requests from the judiciary to lift the immunity of twenty deputies, and the presidency of the parliament in the last session tried to cover up these deputies by forming a committee called the “Committee to Lift Immunity”.
At the time, the Parliamentary Committee did not submit its final report to the Presidency of Parliament for presentation in the dome of the House of Representatives, which deals with lifting the immunity of a number of deputies accused of involvement in issues of terrorism, corruption, defamation and slander.
Al-Aboudi explains that "some of those who will be prevented from participating in the upcoming elections are current and former representatives, former ministers, directors of independent bodies, governors, and deputy ministers, in addition to two ministers from the current government," noting that "most of the deprived are current and former representatives."
