, legal expert, Ali al-Tamimi, on Monday, the form of government, in the event of the failure of the President, Barham Saleh, to choose an alternative to the outgoing Prime Minister, Adel Abdul Mahdi, during the constitutional period of 30 days.
Al-Tamimi said in a statement received (Mawazine News), a copy of it, that "the term of the President of the Republic to assign a new candidate and a candidate other than Abdul Mahdi, who is considered the candidate of the largest bloc because it was silent when his nomination and silence in the need for opinion acceptance, within a period of 15 days as the article says 76 P3, 4 and 4, said another new candidate. "
He added, "This means that the President of the Republic is free unrestricted in the choice of both independents and competencies even if it clashes with the blocs in the parliament and did not vote on his candidate, because he has popular support and is the source of authorities and thus end the quota and turn to a new stage according to what the masses want."
He explained that "in case the President of the Republic fails for any reason whatsoever in the selection and the 30-day constitutional period has passed here, the government of Abdul-Mahdi will end the caretaker business and the administration of the country will be transferred to the President of the Republic, in accordance with Article 81 of the Constitution and for a period of 30 days until a new candidate is appointed. We are in front of a vacuum in the constitutional provisions for non-treatment. "
He pointed out that "these periods and civil constitutional ceilings are sacred and irreversible, and may be resorted to the Federal Court if these hypotheses occurred."
