For the fourth time in 3 months, the Media and Communications Commission violates its law and the constitution by dictating to the media

18/6/2022
The Media and Communications Commission issued a directive to all media outlets to prevent the appearance of the brother of the former governor of Basra, Ismail Musabeh Al-Waeli.
The commission explained in the letter of guidance that it relied on preventing Al-Waeli from appearing in the media on the Diwani Order (65) of 2004 in force, and Article 38 that guarantees the freedom of journalistic work, adding that it issued the uncles for “the guest Al-Waeli’s violation of the media broadcast regulations, by making statements targeting the political and democratic process, And stir up conflict between the components of society.
The book emphasized all media, by blocking the appearance of any person, regardless of his position or position in society, who discloses information to public opinion that would target a specific group in power, or issue information targeting an individual or a ruling group, with the pretext of preventing igniting sedition within society, according to the authority.
The commission appended its letter to instruct all media workers to prevent the use of expressions of mockery or disapproval towards the issues taking place in the arena, especially if they offend a specific party, and to prevent accusations against those in authority. This dictation is the fourth of its kind in the past three months only.
The Association for the Defense of Press Freedom in Iraq expresses its astonishment at the commission’s uncles, who are devoid of any legal basis, and their indifference to the minds of journalists, as Diwani Order 65 is devoid of mentioning or even hinting at bans or blocking, and does not give the commission the authority to direct or dictate the media. .
The association expresses its concern about the return of the commission to the deviations that occurred in the past years, after claiming to reform its approach, and to move towards protecting it as an independent body, away from the pressures of the three authorities, and stresses that the commission is a regulatory body, not a supervisory body, and it does not have the authority to impose restrictions on the media to prevent them From hosting one person without another.
The commission also contradicts in the guidance book all the legal articles it relied on to block, and mentioned them in the guidance book, because these legal articles guarantee freedom of the press and expression of opinion, and the constitution did not set them up, to restrict the media and freedom of expression.
The association reiterates that it is fully aware of what is stated in Order 65 under which the authority operates or its broadcast regulations, as it did not include any blocking of guest appearances, in media licensed by the authority, or not licensed.
Also, the media are not responsible for the opinions expressed by the guests, while hosting them in the programs, as they fall under the law of freedom of expression, which is guaranteed by the constitution.
The association calls on the Media and Communications Commission to work according to the contexts in which it was established, as it is an independent body, and its work is employed to regulate the work of the media, and not impose restrictions on it, by making decisions outside the context of its organizational work, to gain the satisfaction of workers in the ruling authority, and to obey their moods, by excluding them from
Freedom of expression and journalistic work, and commitment to the constitution, especially since the Iraqi constitution abolished the Ministry of Information from the structure of the Iraqi state in order to preserve freedom of expression and journalistic work.
