The head of the Martyrs, Victims and Political Prisoners Committee in Parliament and member of the Al-Sadiqoun parliamentary bloc, Hassan Salem, revealed today, Tuesday, their efforts to amend the Personal Status Law, especially Article 57.
Salem said, in a statement received by Mawazine News, “It is very shameful that There are laws that contradict Islam, as it is the official state religion, and according to what the Constitution stipulates in Article (2), first: “Islam is the official state religion and is a basic source of legislation.”
Salem continued, saying, “As well as Paragraph One (A), which stipulates (It is not permissible to enact a law that conflicts with the constants of the provisions of Islam), and therefore the Iraqi Council of Representatives, as the legislative institution, must correct many laws that violate the Constitution, especially Article (57) related to custody, which has caused a lot of From social problems, the disintegration of families, and the loss of children.”
Salem indicated that he was seeking “to collect signatures to demand the inclusion of an amendment to this law, especially since there is a great desire by members of the House of Representatives for the amendment, especially Article (57), due to the receipt of many appeals and demands from the Iraqi people, given that the House of Representatives is the representative of the people.”
Article 57 of the proposed new draft personal status law constitutes a point of contention in the Iraqi street because it grants the father the right to custody of the child after he reaches the age of seven, while the current effective law grants the mother the right to custody of the child until he reaches the age of ten.
