    On Tuesday, the Federal Supreme Court issued a non-neighborhood ruling granting the power to impose penal sanctions on members of the executive branch.
     
    The court affirmed that these penalties are exclusively the jurisdiction of the federal judiciary. 

    "The Supreme Federal Court affirmed in its ruling No. 12/2016 that previous laws and decisions of the dissolved Revolutionary Command Council authorized some members of the executive authority to impose penal sanctions such as imprisonment, Or imprisonment in lieu of a fine or arrest. " 

    He added that "the court confirmed that these are not judges belonging to the federal judiciary, but are civil servants who carry out executive work," noting that "the power to arrest or imprison persons exclusively judges, and may not exercise these powers of others, after the issuance of the Constitution of the Republic of Iraq For the year 2005 ".

    Samuk added that "granting these powers to non-judges comes contrary to articles (37, 47 and 87) of the Constitution, because these functions are the exclusive jurisdiction of judges belonging to the judiciary."
