Wives ask for divorce through a lawsuit before the family court, and they deceive by notifying the husband of what is happening at an address where the husband does not reside and is not his place of residence.
The Ramadan 2023 drama, specifically the series “Jaafar Al-Omda”, shed light on this type of dislocation, and the wife’s resort to marrying another person, which represents the destruction of the Egyptian family and leads to its dissolution.
I demand that Parliament put in place strict procedures in divorce cases and amend the law to guarantee the husband's right to defend himself or his representative before the judge.
Abu Zaid told “Sky News Arabia” that:[/size]
[size=45]Article No. 20 of the Law of Litigation in Personal Status Matters No. 1 of 2000 allows the wife to file a lawsuit for divorce by divorce, and this may be done in many cases without achieving the declaration of a lawsuit for divorce with regard to the husband, as happened in the series “Jaafar Al-Omda.”
This circumvention of the law requires legislative intervention, as it invades factors that destroy the Egyptian family. Therefore, I suggest that the new draft family law currently being prepared, which includes all laws and matters related to personal status in one law, contains new controls for the issue of divorce by law.
The divorce must take place in the presence of the husband or his representative before the judge, and the divorce must not take place in the absence of one of them.
In some cases the husband may be traveling, so I suggest that the husband be notified by means of modern communication, in light of the tremendous technological progress, so that the court is sure that the declaration of arrival has been fulfilled.
In the event that the husband neglects to attend or appoints a lawyer on his behalf, within the periods stipulated by the law, the legal procedures for divorce shall proceed normally.
In some cases, after the wife obtains a ruling to divorce her husband without achieving the declaration of the lawsuit through notification at a fictitious address, the husbands resort to proving that he did not have the declaration, and thus it is possible for the court to rule that the divorce is invalid, at the same time it is possible that the wife had married a person Another, and here we are facing a catastrophe related to the woman’s union between two spouses, so I suggest that the khul’ ruling be in the presence of the husband or his representative before the court.
For her part, Maha Abu Bakr, a lawyer in cassation and secretary of the Women’s Committee of the Nasserite Party, defended the divorce law and explained to “Sky News Arabia” that:[/size]
[size=45]Khula is the most humane law that has been approved in favor of women.
The loophole is not in the divorce law, but rather in the procedures in general.
Failure to notify the defendant occurs in all cases, not only in khula.
The real problem lies in the procedures, not the law.
The solution is to change the procedural law to ensure that the defendant is properly notified, and this is the role of Parliament.
With regard to the ability of dramas to address issues of concern to society, art critic Tariq Al-Shennawy explained to “Sky News Arabia” that:[/size]

Issues related to women are social issues, and because their laws relate to the family and the social aspect, some believe that they are linked to Sharia and should not be approached.

The erroneous readings resulted in problems in inheritance, and in the so-called guardianship council, that is, when the father dies, the grandfather is the guardian and not the wife, as well as the issue of circumcision, all of which are erroneous readings, and therefore these issues were raised in artistic and dramatic works this year.[/size]
