Both the State Council and the Ministry of Finance registered their objection to the mechanism that was established in the draft law on the care of minors.
Minister of Justice, Khaled Shawani, told “Al-Sabah”: The law on the care of minors needs to be amended like its counterpart laws as a result of the developments that are taking place, represented by economic instability in Iraq and the fluctuation of currency prices, which has greatly harmed the segment of minors, noting that the sums of money that were deposited In the 1980s and 1990s it was still worth the same versus other financial assets.
He added that such a matter requires the formulation of new laws that preserve these rights and the cash that was deposited in the minors’ fund at any time and place and with the same value that was deposited at the time, indicating that the ministry went towards amending the law and prepared a new draft that is present in the State Council, but he objected. With the approval of the Ministry of Finance on the mechanism that was established in the draft law for the purpose of redressing the segment of minors.
Shawani explained that the law stipulates that the amounts be valued in gold, which is a fair, humane and natural requirement for the right of the minor. The law gives authority to the executive authority represented by the Ministry of Justice or the Council for the Welfare of Minors, which consists of a group of ministries, and the right to invest their money, which the government bears responsibility for investing in the required manner and in its proper scope.
He pointed out that it is the state's duty to pay the differences between the value of the deposit and the time of withdrawal, which prompted the ministry to value it in gold, and it insists on this right and the equation to do justice to that segment, otherwise the injustice against them will continue during the next stage.
