Shafaq News / Parliament Speaker Muhammad al-Halbousi decided, on Monday, to issue administrative orders in the House of Representatives to “exclusively sign it and not authorize anyone to do so,” while the First Deputy Speaker of the House of Representatives Hakim al-Zamili responded to al-Halbousi’s uncle, and indicated that the Federal Court did not issue a document. Legally, by changing the presidency, he confirmed that the authority to supervise and control all employees and workers in the General Secretariat of the House of Representatives is entrusted to the presidency of the Council.
Parliament Speaker Muhammad al-Halbousi said in a circular addressed to the Secretary-General of the House of Representatives and all departments and formations of the Council, which was reviewed by Shafak News, "Based on the text of Articles (48) and (53) of Parliament Law No. (13) of (2018), which includes the implementation of The legislation in force and the details of the administrative work and the formations of the Council, the issuance of parliamentary orders are issued with our signature exclusively, and we do not authorize anyone to do so.
For his part, Al-Zamili responded in his circular to members of the House of Representatives, and Shafak News reviewed it, "In reference to the circular of the Office of the Speaker of the House of Representatives in the number M.M. / 226 on 4/4/ 2022, we would like to state that the texts of Articles (8 second) and (9) of the system The internal procedures relating to the Presidency of the House of Representatives are consistent with the provisions of the Constitution, and do not conflict with it, nor with the exclusive powers of the Speaker of the House of Representatives defined by the Constitution.
Al-Zamili added in his circular published on today's date and signed in his name that "the decision of the Federal Court referred to in the aforementioned circulars did not include the text of the unconstitutionality of these articles or their abolition, and did not include any notification to the House of Representatives, and its decision is published on the court's official website within the classifications of decisions interpretation, not decisions (constitutional oversight that includes a ruling that legislation is unconstitutional).
Al-Zamili continued, "In addition, the Federal Supreme Court has launched the term (elected Presidency of the House of Representatives), in its state decision No. (1 and 2 / federal / state order / 2022) dated 1/13/2022, without any objection or comment regarding unconstitutionality. Which can show the constitutionality of this expression and the absence of any reservation by the court regarding it, in addition to the expression of the Presidency of the House of Representatives has been mentioned in a number of laws in force.
Al-Zamili concluded his first uncles by saying, “Therefore, and based on the provisions of Article (130) of the Constitution, which stipulates that (the legislation in force shall remain in force, unless it is repealed or amended, in accordance with the provisions of this Constitution), these two texts and other legislative texts that relate to the Presidency of the Council of Ministers Representatives are considered valid, and there is no basis for saying otherwise,” while I also attached a writ of the Federal Court in “what he prepares” in support of his first generalization.

Al-Zamili added that “the authority to supervise and control all employees and workers in the General Secretariat of the Council of Representatives is entrusted to the Presidency of the Council, and that the Presidency is responsible for the General Secretariat of the Council, and that the Secretary-General of the Council is responsible to it based on the provisions of Articles (9/twelfth/a).” And (147/ first and second) of the council’s bylaws.
Al-Zamili added that “therefore, directing the conduct of an administrative investigation or approving the directing of penalties against employees is entrusted to the Presidency of the Council, and we note in this regard that the provisions of the State Employees Law No. 14 of 1991 have empowered the Undersecretary of the Ministry and those of his rank and general managers the power to impose penalties on employees, Therefore, it is a fortiori that these powers are entrusted to the Presidency.
