Baghdad / Obelisk: Looming on the horizon of the political movement, positions regarding the difficulty of amending the constitution in Iraq, despite the demands and the urgent need for that.
A draft was submitted to amend the constitution to the President of the Republic, while the Parliamentary Legal Committee considered that the amendments proposed by the government would cause problems with Parliament.
The amendment requires the vote of the members of the House of Representatives by an absolute majority, and the opinion of the people must be taken in it.
Lawyer Ali Adnan al-Sharifi stated that the amendment of any article of the constitution can only be done with the approval of the Iraqi people in a general referendum, and this article was voted on by the Iraqis in the 2005 referendum, and amending the constitution is not an easy thing, considering that the constitution of Iraq is one of the rigid constitutions in constitutional jurisprudence.
The expected amendments include determining the largest bloc that wins the elections, which is concerned with the formation of the government, the administration, the sharing and distribution of the oil wealth, and the relationship of the regions with the federal government.
The government can propose amendments, or the deputies agree to form a committee to amend the articles of the constitution.
In 2019, the Iraqi Council of Representatives formed a committee to amend the constitution against the backdrop of popular protests, but the committee did not make any progress towards the amendments, due to a political rejection of that.
In an indication of the importance of the amendment, the Iraqi Prime Minister, Muhammad Shia' al-Sudani, and the leader of the National Coalition, Iyad Allawi, discussed the national dialogue initiative to amend the articles of the constitution.
The leader in the framework, Mahmoud al-Hayani, admits that amending some paragraphs of the Iraqi constitution will lead to political differences, pointing out that there is a division of views on the amendments, which means objection to the move of the Iraqi Prime Minister, Muhammad Shia al-Sudani, in this regard.
He said, “Amending some constitutional clauses requires political consensus, and frankly, there is no political consensus in this regard, as there are many differences over the amendments of some constitutional clauses.”
The academic, Dr. Sattar Al-Jabri, talks about the veto of three Iraqi provinces on any amendment, and in light of intense political tension and tense relations between the center and the region, any amendment seems impossible, and all that is involved is the granting of consolation positions to certain people and parties.
