“Consensus” disrupts laws in parliamentary culture

The Parliamentary Culture, Tourism and Antiquities Committee reported that there are many lagging laws due to the consensual structure of the state, as no law passes without the agreement of the political blocs, and among those laws are: the National Day, the Iraqi Media Network, and Intellectual Property.
The head of the committee, Farouk Hanna Atto, stated in an interview with “Al-Sabah” that “the laws in the committee are lagging in the process of being matured and approved, including the Iraqi National Day law, which was originally part of the official holidays law, and until now there is no specific day as a national holiday that Iraq celebrates.” ».
He added, “According to the draft law that was received from the government from previous sessions and was read first and second, and we entered into many discussions, including choosing July 14, which did not take its turn, and it was originally the national holiday designated for November 23, the day Iraq entered the League of Nations.” United States, but we were surprised that after drafting the legal text for a vote on it; With 72 signatures received by members of the House of Representatives, they reject this date as a national holiday, because there was another proposal submitted by one of the representatives that the national holiday be the day of declaring the sufficient jihad (the fatwa of Sayyid al-Sistani), and the law was obstructed, and so far the law has not passed.”
He continued, "There are other laws, including a draft to amend the Iraqi Media Network Law, and the network's trustees were hosted. We felt that there were legal gaps and an overlap in powers between the trustees and the head of the network and some other matters in the law. We have currently submitted it to the first and second reading and are in the process of agreeing in the committee during the next few days on... Drafting the final text for a vote.
He pointed out, “There are also many laws, including the right to obtain information, which is one of the important laws in Iraq, because Iraq is included in agreements such as freedom of opinion, human rights, and others. If we were able to provide a good text, we would have established the law in accordance with international standards and dealing with the state transparently.” “This is an important issue, so there will be a workshop in this regard hosted by the competent authorities,” stressing the need to mature this important law and not rush to approve it because it is one of the very important laws.
Atto noted that “the other important law with which the committee is involved is the intellectual property law, which has been submitted to the Presidency of Parliament and will be included on the agenda of the upcoming sessions.”
The head of the committee warned that “the state’s consensual structure contributes to obstructing the adoption of laws, and if the blocs do not resolve these issues, the laws will remain hostage to political agreements, such as the freedom of expression law and other laws.”
He concluded by saying: “The committee has presented many law proposals, but they are stalled at the present time, such as the proposed law for the Ministry of Culture, which is still subject to the old law, and the committee is not slowing down on these issues, but this is the composition of the House of Representatives and the political process.”
