Member of the Legal Committee, Mohammed Al-Khafaji, acknowledged the difficulty of passing the amendment to the Personal Status Law easily, noting that there are many comments on the amendments that will be discussed and corrected to remove any ambiguity. Al-Khafaji told Al-Sabah: Although the current law is strong in terms of law and formulation, it includes some provisions that conflict with Islamic law, which prompted some judges to try to adapt the general articles to be consistent with Sharia, adding that the existence of explicit and clear laws will eliminate the need for such adaptations and prevent any violations, especially in cases related to custody and wills. Al-Khafaji pointed out that the proposed amendments aim to correct provisions that violate Sharia, and that the Iraqi constitution and the religiously diverse society allow this possibility, indicating that the diversity of sects in Iraqi society requires, in return, the existence of diversity in Sharia provisions, which reflects the true identity of the Iraqi people. Al-Khafaji explained that there are two options regarding the current law; The first is to keep it as it is, and the second is to add clear Sharia provisions that are compatible with Sharia and to codify these provisions within legal articles that are in line with the four schools of thought or Shiite jurisprudence. Regarding the attack on the amendments, Al-Khafaji said: The reason is due to the failure to present the amendments correctly and clearly to the public, adding that the law has already been read for a first reading, and there are many comments on the amendments that will be discussed and corrected to remove any ambiguity. Al-Khafaji revealed that the new law will not add anything new regarding marriage outside the court, except for lifting the penalties imposed on it, noting that the code will be covered by Sharia provisions that are being formulated by the Sunni and Shiite endowments, with the possibility of disagreements that may lead to obtaining the code from religious references to present it to Parliament.
