Ebadi said “The Constitution’s 140th article determined the steps the executive authority must take to complete the implementation of article No.58 of the Iraqi state administration law for the transitional stage,” noting “According to article 140/ second item, 31/December/2007 was identified a date to implement this article.”
“Article No.140 is considered to be invalid due to lack of its implementation in the mentioned period, so it needs new legislation to carry out the steps that need to be put into force which are stated in article No.58 of the state administration law for the transitional phase which involves reinstating the immigrants and exiles to their homes, however, if this was impossible, then the government has to compensate them,” he added.
The commission of the article No. 140 of the Constitution was formed in 2007 and its task is to supervise the normalization of the situation in Kirkuk and the disputed areas and pay compensations for the deportees and the arrivals.
