     The International Criminal Court (ICC) said it would refer Jordan to the UN Security Council because Sudanese President Omar Hassan al-Bashir was not arrested when he visited Amman in March.

     

    Bashir was invited to visit Jordan, on 29 March 2017; to attend the Arab summit held on the shores of the Dead Sea there.

     

    The court issued a warrant for the arrest of Bashir in 2009 and 2010 because of his role in war crimes, including the genocide in the Darfur region. Jordan, as a member of the court, is obliged to execute the arrest warrant.

     

    Khartoum is not a member of the Hague-based war crimes tribunal, so the court does not have automatic jurisdiction to investigate war crimes in Sudan.

     

    The United Nations Security Council has the authority to impose sanctions on those who have not cooperated with the International Criminal Court, but has taken no action against such cases.

     

    The diplomatic row broke out when Bashir visited South Africa in 2015, and Pretoria was not arrested.

     

    The South African government said at the time that if it did so to violate Bashir's immunity as head of state, this justification was rejected by the courts in South Africa, as rejected by the International Criminal Court.

     

    The court did not resolve South Africa to the UN Security Council, saying it had not anticipated any impact.

     

    Kenya and South Africa threatened to withdraw from the International Criminal Court (ICC) because of what it called the court's bias against African countries.

     

    Prosecutors accuse al-Bashir of five crimes against humanity, including murder, genocide, forced transfer, torture, rape and war crimes, including attacks on civilians and looting.

     

    Bashir also faces three genocide crimes committed - according to the court - against ethnic groups - Fur, Masalit and Zaghawa in Darfur - between 2003 and 2008.
