the Federal Integrity Commission revealed, on Tuesday, the details of the convictions issued against the former head of the National Retirement Authority and the director of the Global Smart Card Company (Ki Card), after the Federal Court of Cassation accepted their request for a retrial.
The Authority’s Investigation Department stated, “The Central Anti-Corruption Criminal Court issued a judgment in the presence of imprisonment (one year and 9 months) against the convicts, the former head of the National Retirement Authority and the director of the Global Smart Card Company (QiCard), after they were re-tried on the charge of the first convict taking a bribe from the second convict. In exchange for facilitating the business of the (Ki Card) company with the National Retirement Authority, indicating that the ruling issued in accordance with the provisions of Resolution (160 of 1983) included the imposition of a fine of (10,000,000) million dinars on each of them.
The department added, "The Federal Court of Cassation - the second criminal body approved the convicts' request for a retrial after it found that it fulfilled the legal requirements, as it was based on one of the reasons stipulated in Article (270) of the Code of Criminal Procedure, due to the emergence of facts and submission of documents that were not conducted by a court." The subject of her investigations,” referring to “the acceptance of the request for a retrial and the transfer of the case file to the court, in order to conduct the trial again, based on the provisions of Articles (270/4, 271, and 275) of the Code of Criminal Procedure.”
And she explained, “The Central Anti-Corruption Criminal Court had previously issued, in early 2021, a 6-year prison sentence against the former head of the National Retirement Authority, in accordance with the provisions of Resolution (160 of 1983), while it issued a 4-year prison sentence against the director of the global company.” For the smart card (Key Card) in accordance with the provisions of Article (308) of the Penal Code and in the context of Article (310) thereof.
The department confirmed, in a statement received by Mawazine News, that "the wisdom imposed a fine of (10,000,000) million dinars on each of the convicts, and in the event of non-payment, they are imprisoned for a period of (9) months, to be implemented successively." Ended 29/N33
