Legal expert Ali Al-Tamimi confirmed that Iraq will be able to win international legal action against Turkey regarding its rights and its share of the water received from the Turkish side.
Al-Tamimi said in a press interview seen by “Taqdam” that “the 1982 Convention, or what is called the Law of the Sea, was ratified by Iraq in 1985, and there is a competent court for that. According to this agreement, which is based in Hamburg, the countries organizing this agreement consist of 196 countries, including Iraq and Turkey. Affected countries have the right to resort to this court in the event that bilateral solutions are difficult.
He added, "The water wars represent crimes against humanity and allow Iraq to resort to the United Nations and the Security Council and request that the file be referred to the International Criminal Court."
And he indicated that “Iraq has the right to resort to the International Court of Justice, and it had previously filed this lawsuit against Turkey before the International Court of Justice, but it lost the lawsuit that was rejected by this court on the grounds that Iraq does not benefit from the surplus water that goes in vain to the Shatt al-Arab. That was in 1987, but Now the situation has changed, and Turkey built the dams and completely blocked the water, and this violates international laws and the above agreements.”
He pointed out that "Iraq can resort to the Court of the Seas to force the riparian countries to obtain its share of water, or resort to the International Court of Justice in the event of Turkey's non-compliance, and in all cases it wins the case."
