The federalism’s violation of the legitimacy of the region’s parliament sparks a dispute over the powers

The Federal Court's decision to veto the extension of the mandate of the Kurdistan Regional Parliament sparked a new political debate in the region. While the Kurdistan Democratic Party clings to the authority of the regional government's mandate, the rest of the opponents seize the opportunity by referring to its transformation into a caretaker government under this decision, and demanding the speedy holding of legislative elections in the region under Supervision of the Federal Election Commission in Baghdad.
The majority of Kurdish parties are still calling for updating the voter registers or relying on the data of the Federal Commission, to eliminate suspicions of tampering with voter numbers in the region.
A member of the Patriotic Union of Kurdistan, Yousef Zozani, said, in an interview with "Al-Sabah": "The Kurdistan Regional Government has turned into a caretaker government with this decision, and thus the terms of reference of the caretaker government in the region must be studied to know what it can do, and what is not among its powers."
For his part, the advisor to the head of the Kurdistan Democratic Party, Saad Al-Hamwandi, explained that "everyone knows how decisions are issued by the Federal Court, and this does not reflect negatively on the Kurdistan Regional Government." Al-Hamwandi added, in an interview with "Al-Sabah", that "the term of the regional government has not ended yet, and it will take time for it to be a caretaker government," noting that "the Democratic Party was the first to stress all political blocs on the need to hold elections in the region on time." .
While the political advisor to the Speaker of the Parliament of the Kurdistan region, Mahmoud Khoshnaw, said: "The decision of the Federal Court is a specific part, which is to extend the fifth session for a period of two legislative terms. As for the parliament, it remains and will remain," explaining that "the regional government entered the caretaker stage after this decision."
For his part, legal expert Latif Mustafa said, "There are three cases when the government turns into a caretaker government. The first is in the event that the parliament's term ends, and until a new parliament is elected and a government is formed, according to which the current government's work will continue as a caretaker government."
And he added to "Al-Sabah", that "the other case is if Parliament is dissolved, whether it was premature under legal mechanisms, or it is dissolved by a decision of the Federal Court, where after the issuance of the decision to dissolve Parliament, the government turns into a caretaker government," noting that "the other case is the withdrawal of Confidence is from parliament, and thus it turns into a caretaker government, and the decision of the Federal Court is a case of it.” The legal expert, Hoshyar Malo, explained that "the current government is a caretaker government, according to the recent decision of the Federal Supreme Court, which becomes a caretaker government, given that the parliament of the region that gave confidence to the government for four years is the same institution that has expired, meaning the end of the mandate that it obtained from the people who are considered source of authority.
