    A decree was issued approving an agreement between Kuwait and Iraq to avoid double taxation and prevent financial evasion with regard to taxes on income and capital.

    The explanatory note stated that in order to enhance mutual economic relations between the Government of Kuwait and the Government of[You must be registered and logged in to see this link.]An agreement was signed to avoid double taxation and prevent fiscal evasion with respect to taxes on income and on capital.


     
    Article (1) of the agreement stated that “it shall apply to persons residing in one or both of the contracting states, and Article (2) stipulated that:[You must be registered and logged in to see this link.]covered by this agreement.”
     
    The agreement included dividends, which means income from shares, usufruct shares, founders’ shares, or other rights that do not represent debt claims, and participation in profits, as well as income from the rights of other companies, such as income from shares, according to the laws of the contracting state.[You must be registered and logged in to see this link.]The income distributing company is considered resident.[You must be registered and logged in to see this link.].
     
    The agreement stipulated the necessity of exchanging confidential information between the competent authorities in the two countries related to the implementation of the provisions of that agreement.
     
    In addition, the agreement excluded income obtained[You must be registered and logged in to see this link.]Resident in[You must be registered and logged in to see this link.]Contracting State in his capacity as a theatre, cinema, radio, television or musical artist, or as a sportsperson, where such categories may be subject to tax in the other Contracting State.
