BAGHDAD / NINA / A Kuwaiti official source announced that Iraq will hand over compensation of Kuwait Airways early next week. The Amiri Decree, published in Kuwait Gazette on Tuesday, is based on the presentation made by Kuwait Deputy Prime Minister and Foreign Minister Sheikh Sabah Khaled Al-Hamad Al-Sabah and Minister of Communications Salem Al-Othaina. It approves the pact reached by the two sides on July 18, 2012, to settle the financial dispute Kuwait Airways Corporation (KAC) and Iraq Airways and stop litigations in this regard. The decree shows that KAC filed a number of lawsuits against Iraqi Airways, the Government, the Ministry of Finance, the Ministry of Transport and other state institutions in Iraq, claiming damages from the Iraqi side. Out of keenness on the sisterly ties, the two countries reached a five-point deal on July 18, 2012, in the State of Kuwait. To become effective, the deal required an endorsement by an Amiri decree pursuant to second paragraph of Article 70 of Kuwait Constitution, the note reads. It is in the best interests of Kuwait in the current delicate state to step up the legislative and executive measures relating to the enforcement of the deal and meet its obligations. As Article 71 of the Constitution allows adoption of decrees with the force of law in case of the absence of the National Assembly (parliament of Kuwait), it was necessary (for the political leadership) to adopt the decree in question to avoid missing the ultimatum for the endorsement of the deal which is about to elapse. The five-point pact provides that the Kuwaiti Ministry of Communications arranges the final settlement of KAC’s claims for damages from Iraqi Airways in a friendly way. The two airlines have to inform their respective international lawyers to stop the litigation process, pending the completion of the final settlement. The Iraqi airline has to pay 500 million US dollars in damages to KAC, including $300 million in a bank to be designated by KAC under an Escraw arrangement, and $200 million to be paid to KAC in the first half of 2013. Kuwait’s Ministry of Communications and Iraq’s Ministry of Transport should finalize the legal procedures relating to the implementation of the deal within three months starting from the signing date. Finally, the accord annuls the deal reached by the two sides on March 14, 2012, without leaving any legal impacts. -KUNA
