The political process in the country entered a new impasse yesterday, Tuesday, which seems to be the most complicated of all the above. While the Presidency of the House of Representatives announced the opening of the nomination for the second time for the position of President of the Republic; The President of the Republic, Barham Salih, addressed the Federal Supreme Court regarding the “constitutional vacuum” and the interpretation of Article (72/second) of the Constitution.
The head of the Law Deans’ Committee in Iraq, Dr. Miri Kazem Al-Khikani, described the opening of the nomination by the Speaker of Parliament as “a bullet in the heart of the constitution,” noting in a hadith: “Article 72 of the Iraqi Constitution of 2005 set the term of the President of the Republic at four years and he may be re-elected for a term of office.” second" .
And he indicated that “the president of the republic was supposed to be elected in accordance with (Article 72/Second/Paragraph B), which stipulated that the House of Representatives must elect a new president of the republic within thirty days from the date of its first meeting, and this is what the Presidency of the House of Representatives did, According to the interpretation of the Federal Court, the President of the Republic will be elected after achieving a quorum for the session of representatives by a two-thirds majority, but this matter did not happen and the session was adjourned to further notice.
He explained that “a law was issued based on the constitution regulating the election of the President of the Republic No. 8 of 2012 and in accordance with this law and according to Article 2 the Presidency of the House of Representatives announced the opening of the nomination for the position of the President of the Republic for a period of three days from the date of the election of the Speaker and his two deputies in its new legislative session, and this is what happened. Indeed, the nomination requests were considered, and a list was announced of the names of the candidates who met the conditions for electing the President of the Republic, and due to the lack of a quorum - as I mentioned earlier - the election was not held.
And he indicated that “opening the door for nomination again is not only a circumvention of the constitution, as much as it is a clear and grave breach of the simplest legal and constitutional rules, and the public prosecution must stand in front of this breach. The constitutional solution is to wait for a quorum to be achieved in Parliament. Announced earlier that they participate in the candidacy for the post of President of the Republic.
In turn, political analyst Dr. Haider Salman said in an interview with “Al-Sabah”: “The decision of the parliament presidency opened the door for candidacy - even if it was unconstitutional - and parties higher than the law and the constitution would stand behind it to pass it, especially since this decision was not an individual decision by the president. Parliament Muhammad al-Halbousi (although it was not even presented to Parliament), but rather by the Triple Alliance.”
He pointed out that “opening the nomination door was decided in advance to exclude Hoshyar Zebari by the judiciary, and only the announcement remained, and according to the political scene, the head of the Democratic Party, Massoud Barzani, will nominate a name other than Zebari to pass, even if he broke the laws and the strength of the tripartite alliance, and therefore the presidency of the republic will go. For the first time after 2003 to (Al-Parti) and extracted from (Al-Ekti - Patriotic Union of Kurdistan), to represent a whole new era of government
