    Law experts and analysts reported that the Parliament Presidency’s request yesterday, Monday, from the current government, to send the budget law for the current year 2022 is incorrect and contradicts the laws, as the government has turned into “the conduct of business and daily matters” and it does not have the authority to prepare strategic laws, including the budget law.
    Despite the directive of Parliament Speaker Muhammad al-Halbousi to address the General Secretariat of the Council of Ministers to send the federal budget for 2022; However, in parallel with the failure of the House of Representatives to convene and elect the President of the Republic, the executive authority (the Presidency of the Council of Ministers) and in accordance with the internal system of the Council of Ministers No. 2 of 2019 of Article 42 stipulated explicitly and clearly in the first paragraph that “the Council of Ministers will continue to conduct the day-to-day business of the state until Formation of the new government.
    Al-Halbousi had directed the parliament’s secretariat yesterday to address the cabinet secretariat to send the budget for the current year 2022.
    Professor of Administrative Law, Dr. Ismail Al-Budairi, said in an interview with “Al-Sabah”: “The internal system of the House of Representatives defined (the conduct of daily affairs) as taking decisions and measures that cannot be postponed that would continue the work of state institutions and public utilities regularly, and does not include, for example, a proposal Drafting laws, contracting loans, appointing to senior positions in the state and exempting them, or restructuring ministries and departments.
    He pointed out that "there is no constitutional vacuum, as some argue, but we are in front of an expired government whose work is limited to following up and taking measures that contribute to the regular functioning of state institutions, and the President of the Republic will continue his work, while state institutions remain incapable of taking important decisions. It is strategic and fundamental, especially in legislating laws or making strategic decisions,” explaining that “in the event that the new government is not formed, we will not be faced with any law enacted by the House of Representatives, especially (the Federal Budget Law) and other important laws that concern the interests of the people.”
    For his part, the researcher in political and economic affairs, Nabil Jabbar Al-Ali, said in an interview with “Al-Sabah” that “for long periods, the state and the political system faced delays in preparing and presenting the budget, so that Iraq was without a budget in the year 2020 and the principle on which the state works was based on the principle (1 / 12) It is the periodic monthly spending of state institutions that is limited to operational spending such as employee salaries and basic expenses all within this principle, which will stop from the budget is investment spending, which in turn will stop development projects and spending on them and the development of the regions, and this halt will cause a kind of economic stagnation, especially since The Iraqis are used to this."
