The government is moving to resolve many outstanding files that have accumulated dust over the years, including the file of daily wages and contracts, and their entitlement to a retirement salary, especially those who spent long years as contractors or employees. The general budget has adjusted the situation of contractors and employees and transformed them into permanent employees, while The financial allocations in the Food Security Law addressed this issue.
Representative Hassan Al-Asadi told Al-Sabah: “There are paragraphs in the general budget related to wages and contracts, and the financial allocations in the Food Security Law addressed the problem for them, and the necessary financial allocations were provided to stabilize them.”
He added, "The general budget allowed confirmation of contractors based on Resolution 315, but it did not include new appointments," and explained that it "allowed the Council of Ministers to work on Resolution 315, and no new confirmation occurred, because it is assumed that employees and contractors were included in the Food Security Law."
Regarding calculating retirement, Al-Asadi said: “There is a unified retirement law that was not mentioned in the budget, in addition to the security law that was approved by the House of Representatives.” He pointed out that “contractors were included in the retirement law, but there are no details in the budget, but rather the matter is entrusted to the Council of Ministers, which Treat it with special decisions.”
The government seeks to close this file permanently, liquidate the remaining daily procedure files, and transfer them to contractors.
For his part, the legal consultant, Saad Al-Bukhati, stated in an interview with “Al-Sabah” that “recently, there have been decisions in the Council of Ministers and the General Secretariat of the Council of Ministers regarding contractors, because they are subject to the State Employees Discipline Law, and every contractor has retirement rights, bonuses, study leave, and penalties.” He added, “There is nothing in the budget law that addresses daily wages because Parliament dissolved them with Resolution 315, and they are treated like permanent employees,” noting that “there is a study on how to solve the issue of daily wages because it is a temporary, immediate issue and has no precise legal conclusions.”
He added, "The issue of procedures will be resolved in the next stage, and they will be converted into contracts and dealt with like employees, and this situation will be left," which he described as "a situation that was imposed politically and not legally, such as an acting position, which emerged to address a specific situation."
Al-Bukhati stressed that “many issues that have not been codified and legislated with specific mechanisms and instructions can be resolved,” and noted that “the contractor’s salary, if he reaches the legal age, is the same as the salary of a permanent employee, and the same mechanisms and controls apply to him.”
