Infrastructure means the service structures needed to run the economy and sustain the improvement of the conditions of community life ... Thus, it includes the basic facilities and services that provide the services required by the community in addition to the main advantage of these contracts is the implementation of development plans funded by the private sector ... It also indirectly helps the state to overcome the political and terrorist crises that may be exposed to it as the major countries usually intervene to help to prevent the danger of projects implemented under the slogan of protecting the interests of companies in the country. This is justified because it is necessary to achieve a suitable profit for the executing company at an agreed rate with the host government of the project. Usually, the pricing of the service with the approval of the host government is based on the basis of the services provided by the government. Cost plus the agreed profit rate ... and certainly this percentage of profit is much less than the cost of corruption usually. It also requires the granting of the right of monopoly to the concessionaire at the expense of users of the service, which requires the existence of a supervisory and supervisory body to follow the contracting party in terms of moderation of price and performance of service specifications agreed upon ... The position of Iraqi law on service contracts The Iraqi Civil Code No. 40 of 1951, in some of its articles, dealt with provisions of general rules applicable to cases similar to those discussed in relation to service contracts. Articles 891-899 referred to the obligation of the public utilities to conclude a contract between the government and an individual or company entrusted with the exploitation of the facility for a limited period of time required by law, specifying the contractual ties between the facility owner and his clients and achieving full equality between its clients in services or in the payment of wages Price definitions have the force of law that contractors can not agree to disagree with.
