Instructions No. (4) for the year 2011 and the grant of pension rights for the families of the martyrs and the injured and missing and abducted as a result of military operations and the mistakes of military and terrorist operations planned by Law No. (20) for the year 2009 (as amended)

According to the provisions of Article (18) of the Act to compensate those affected by the military operations and the mistakes of military and terrorist operations No. (20) for the year 2009.
we issued the following instructions: -
Article 1
Apply these instructions to the employee on the permanent staffing and contracted in government departments and the public sector and a member of the armed forces and internal security forces, including the protection of installations and other security services who did not distract him the amount of the grant in accordance with the provisions of the law on compensation for those affected by the military operations and the mistakes of military and terrorist operations No. (20) for the year 2009, and the mixed sector employees and citizens who cites or injured or becomes totally or partially lost or kidnapped as a result of military operations or mistakes military or terrorist operations.
Article 2
Aola_ formed in each ministry or party is linked to the Ministry of the Commission, or more than three (3) employees to be one of them obtained a college degree at least in the initial law.
Secondly _ The Committee shall set forth in item (i) of this article as follows:
A _ received requests for the martyrs and the injured covered by the provisions of Article (1) of this instruction of employees of the state in any capacity together with the leaves of the investigation conducted by the police station and the death certificate in the case of martyrdom and the decision Special Court of loss and the medical report your injury or disability in favor of a medical committee competent official.
B_ an administrative investigation to prove that the act was actually a result of an act of war or military error or a terrorist act after reviewing the investigative papers.
J_ submit its report and recommendations, together with all the archives through the (15) fifteen days from the date of registration of the application in the Ward Committee to the competent minister or head of the Giralmrtbth Ministry for approval.
Third - To authorize the Secretary of Defense Senior Military Advisor to the Ministry of Defense the authority to approve the recommendations of the Committee set forth in paragraph (c) of the item (ii) of this article.
Fourthly - Minister of the Interior to authorize any of the agents the ministry the authority to approve the recommendations of the Committee set forth in paragraph (c) of the item (ii) of this article.
Article 3
Sent as a result of the investigation and the recommendations of the Committee set forth in paragraph (c) of the item (ii) and items (iii) and (iv) of Article (2) of these instructions to:
First - the Sub-Committee in the province competent set forth in item (ii) of Article (3) of the Act to compensate those affected by the military operations and the mistakes of military and terrorist operations No. (20) for the year 2009, to pass a resolution compensation during the period specified in paragraph (e) of the item (iv) of Article (6) of the Act and the Sub-Committee to provide the ministry or the party is associated with the Ministry of compensation with Protozoa decision to take the necessary procedures for the disbursement of the grant amount stipulated in Article (9) of the Act.
Secondly - the national pension with a copy of the Securities investigative and a certified copy of the death certificate and the Qassam legitimate argument guardianship or argument Agaymoma in the case of a minor or of equivalents and the medical report with the treatment of pension through ten (10) days from the date of completion of the report for the purpose of disbursement of pension rights.
Article 4
First - is committed to those with missing or abducted by taking the following measures: -
A - to provide a certified copy of the investigative papers organized by the police station to the ministry or the party is associated with the Ministry in which it operates missing or kidnapped.
B - Review the competent courts to declare the case of loss or kidnapping.
C - Review the competent courts for obtaining the argument of loss and a monument to the values of the missing or abducted.
D - Revision circle care of minors to open a private Bamufcod binders or kidnapped from which to communicate with the Department of missing or abducted.
Second - take the ministry or the party is associated with the Ministry in which it operates missing or kidnapped the following procedures: -
A directorate general sexual overture to make sure airports and border crossings of the defendant not to leave the shedding or abduction of the Republic of Iraq.
(B) Representation approached the Kurdistan Regional Government in the General Secretariat of the Council of Ministers to make sure not to leave the defendant shedding or abduction of the Republic of Iraq by airports in Erbil and Sulaymaniyah.
Article 5
Been corrected typo under a statement issued on 1/8/2011 in the Official Gazette numbered 4201, corrects typo contained in paragraphs (a) and (b) of the item (ii) of Article (5) the number of instructions (4) for the year 2011 issued Ostnadullmadh (18) of Law No. (20) for the year 2009, to read as follows: _
First - A. The ministry or the party is associated with the Ministry of exchange with the grant amount to the martyr referred to in Article 10 of Law No. (20) of 2009 or the injured from the allocations of bonuses in its budget after verifying that the martyrdom of injury or loss as a result got one business covered by the above mentioned law.
b - The Ministry or entity is associated with the Ministry notice Budget Department in the Ministry of Finance to cover disbursements.
Second. A. The department, which works out the missing or abducted after the completion of the procedures set forth in Article (4) of this instruction, regardless of his salary, according to the decision of the Revolutionary Command Council (dissolved) No. (88) for the year 1987 until his death proven fact or judgment ..
b. Granting pension and grant to those with missing or abducted in the case of proven fact or death sentence according to law No. (20) for the year 2009 ..)) ..
Fifth paragraph added under the instructions of the First Amendment No. 2 for the year 2014
Article 6
First - The applications for citizens and volunteers of the martyrs and the injured and missing and abducted while they are on the doors of volunteer centers of the armed forces and internal security forces and other security services or their relatives from not covered by the provisions of paragraph (a) of the item (ii) of Article (2) of these instructions to committees Sub in the province where the accident occurred, together with leaves investigation conducted by the police station and the death certificate in the case of martyrdom and the decision of the Special Court of loss or kidnapping and report your medical injury and disability in favor of a medical committee competent official.
Secondly - Tibet subcommittees requests set forth in item (i) of this Article within sixty (60) days from the date of registration of the request has.
Thirdly - The province concerned exchange amount of the grant to covered by the provisions of item (i) of this Article in accordance with the amounts set forth Article (9) of Law No. (20) for the year 2009.
Fourthly - send its sub-committees to the national pension and pension transactions
accompanied with a CD-ROM (CD) contains the following information: -
(A) Full name of the martyr and the title, if any.
(b) the date and place of birth.
c - the name of the parent trio.
d - Date and place of martyrdom and leaves the investigation conducted by the police station.
AH - Qassam legitimate or image certified.
, and - the death certificate.
g - original copy Guardianship of the argument or the argument Agaymoma in the case of a minor believe in the rule, or a photocopy and certified in accordance with the asset.
V. The Committee shall transmit a copy of the decision of the central covered by the provisions of the Compensation Act affected by the military operations and the mistakes of military and terrorist operations No. 20 for the year 2009 to the competent authority to give him a piece of residential land stipulated in Article 13 of the law without the need to submit a request to do so.
Article 7
Be challenged in the decisions of the sub-committees in front of the Central Committee provided for in Article (4) of Law No. (20) for the year 2009.
Article 8
If covered by these instructions or his family have been given less than what he deserves compensation under Law No. (20) for the year 2009 shall be granted the difference between what is and what deserved Exchange under the law and according to the procedures specified in this instruction.
Article 9
The provisions of the law of disability health staff number (11) of the year 1999, and the instructions number (14) of 2000 issued thereunder while not mentioned in these instructions, including, without prejudice to the provisions of Law No. (20) for the year 2009.
Article 10
These instructions are published in the Official Gazette and is effective from the date 20/3/2003.
