Ten years ago, 14 Iraqi governorates witnessed elections for their councils in the year 2013. It was not expected at the time that the scenes of the local electoral process would be absent from the scene for this period. The elections were postponed in Kirkuk Governorate, just as they were not held in the governorates of the Kurdistan region.
Many exciting events occurred in the country, most notably the war on terrorism, which made members and heads of some provincial councils look for alternative cities to carry out their work, after criminal gangs invaded their areas, and the political conflict continued in one crisis after another, until the House of Representatives voted to freeze the work of the provincial councils, After the October 2019 demonstrations.
Four years and the governorates are without their councils!
Former member of the House of Representatives, Riyad Gharib, said in his interview with Noon News Agency: “Provincial councils are supposed to be services that provide services to people, but the problem of political money that brings members to provincial councils is not at the required level, and their spending large sums of money before the elections pushes them to compensate for it and pay attention to the negative side.” And leaving the issue of services, there is one positive and important thing for the governorate councils, which is monitoring the governor’s performance so that he is not alone, since most of the governors’ work is dominated by corruption and lack of proper performance in projects, and they have many technical problems that will soon appear to the public in completed projects, such as paving and siding because they do not meet specifications, and most of them are tainted by corruption. ".
Gharib asserts that “provincial councils are constitutional and cannot be abolished, and when their work was frozen in the last stage, there was an improvement in the performance of some governorates, and we need constitutional changes so that these councils become more like municipal councils without salaries that attract people with expertise, experience, and high technical capabilities to carry out their role, and not “Applying for the sake of salary.” He explains that “if the provincial councils worked in a correct manner like the countries of the world, performing their supervisory role over the governors and providing their expertise in addition to following up on the performance of the departments’ work and monitoring projects and the quality of work, their results would be good.”
He believes that “the ideal solution lies in the governor being elected by the people or appointed by the Prime Minister or the Ministry of Interior and other ministries, but the constitution specifies that the governor be elected through the governorate councils, and the governorate councils are elected by the people to exercise their oversight role.”
He points out, “Members of the House of Representatives are supposed to take their real role in following up on the governor’s work, but some governors who violate the law withhold the information contained in referring projects.”
The elections will be rigged in a vulgar manner
. For his part, the Political Affairs Observer believes that Al-Rubaie “will rig the elections in a vulgar manner and in a greater way than the 2018 elections. I expect that changing the election law currently will be in the interest of the large parties that are at the forefront of the scene through their possession of money and weapons, and because the law is based on ratio and proportionality ( 1.7) The preliminaries for its application in the Iraqi reality currently do not exist. For example, the law on parties and their financing (where did you get this from?) is not implemented. If it had been applied, the equation would have been different, in addition to other laws and details.”
Speaking to Noon News Agency, Al-Rubaie expects that “the rate of holding local elections will be 50% unless a new emergency occurs, the escalation of the problem in Gaza and the opening of the doors to a greater conflict on several axes, and the ambiguous circumstances in the absence of the intervention of the Sadrist movement, and it is possible to look at The possibility of postponing the elections may be due to an emergency factor that is not currently taken into account, which is the situation in Kirkuk. In the event that one of the parties wants to postpone the elections, the Kirkuk elections currently have a question mark and can be exploited, but in light of the current situation and if the circumstances of the election day are like now, I expect that they will take place on the specified date. ".
Whether or not provincial councils exist is one!
Al-Rubaie believes that “the presence or absence of local councils did not affect the reality of the governorates, because the equation is essentially not subject to the general interest of the people. The governors and councils did not exist in order to compete to provide a service, but rather to compete to gain the spoils, and in the final outcome the governor is in the shadow of The provincial councils were not working, and after the councils’ work was frozen as well, and his previous excuse was the existence of the council, but today he is using other matters as an excuse, including finance, laws, and bureaucracy.”
Al-Rubaie says, “The idea of provincial councils to exist and through them a governor and council president are chosen is a very wonderful idea. In most of the world’s democratic countries that enjoy true democracy, transparency, and a state of institutions, implementing them leads to stability, progress, and prosperity, but in current Iraq, whether the councils exist or not.” It makes no difference, and all that matters is that the blackmail now, instead of being between the council and the governor, has become direct between the governor and the influential parties.”
The absence of the Provincial Council reflected positively on Karbala,
the researcher in political affairs, Dr. Ghaleb Al-Daami, stated during his speech to Noon News Agency that “the existence of the provincial councils is constitutional from a legal standpoint, but it is not necessary to apply all parts of the constitution, especially with regard to institutions, as there is a federal council.” Constitutional, but the House of Representatives refuses to legislate its law, meaning that the provincial councils are not necessary at the present time, and their absence has had a positive impact on the work of the provinces, and the best example is that some provinces have made a great progress, including Karbala.”
It is hoped that local elections will be held on December 18, and these will be the first local elections held in Iraq since April 2013. The elected provincial councils will be responsible for selecting the governor and the governorate’s executive officials.
