    The existence of housing, which is sheltered by man is one of the most basic and indispensable necessities. The dwelling is the place where a person takes a place to live permanently or temporarily, whether it is owned by him or to others and he owns the use of it. The sanctity of the dwelling is directly related to the right to privacy. It is not permissible to enter a dwelling without the permission of its owner, which was established by the celestial legislator and the national constitutions. The Iraqi Constitution of 2005 stipulates that Article 17/1 stipulates: In personal privacy including Incompatible with the rights of others) paragraph 2 of which states:
     The legislator intervenes and develops texts to safeguard rights and freedoms because of their attachment to the fundamental interests of a particular individual or group of individuals. Individual or collective rights are considered worthy interests to be protected. And their stability.
