    [size=45]Yesterday, Sunday, the Ministry of Finance called on all ministries' spending units to review them to receive instructions for implementing the budget, while indicating that the appeals that pursue legislation do not delay the implementation of the law.[/size]
    [size=45]The ministry stated in a statement that (Al-Mada) received a copy of it, “We invite all spending units of ministries, governorates, bodies and entities not associated with the Ministry to attend to the Ministry of Finance / Budget Department on Monday 4/26/2021 for the purpose of receiving instructions for implementing the general budget for the fiscal year 2021 and instructions for implementing the budget. Planning for the public sector, self-financed bodies and companies.[/size]
    [size=45]The statement added, “This came after the legislation and publication of Law No. 23 of 2021 of the Federal State Budget of the Republic of Iraq for the fiscal year 2021 in the official Iraqi newspaper Al-Waqi’a issue 4625 on April 12, 2021.[/size]
    [size=45]And she added that "the instructions for the federal budget for 2021 were completed after a final audit was conducted by the Ministries of Finance and Planning," noting that "budget appeals will not delay their implementation."[/size]
    [size=45]In a related context, Representative Hussein Arab stated that the amendments to the budget came in coordination with the government before the vote on it, indicating that Parliament did not exceed its powers in this aspect.[/size]
    [size=45]Arabs said, in a statement to (the extent), that "Parliament did not exceed its constitutional powers when it made amendments to the draft budget before it was enacted."[/size]
    [size=45]Arabs added, "The issue did not include any increase in funds. On the contrary, we went to reduce the overall budget law, as well as the deficit, to very good rates."[/size]
    [size=45]He pointed out, "The transfer, although it is one of our powers, was based on consultations with the relevant ministries and directors of government spending units in state institutions."[/size]
    [size=45]And Arabs went on, that "the budget in general, has been discussed in an expanded meeting with the Council of Ministers and we have agreed on its general guidelines before voting on it."[/size]
    [size=45]It is noteworthy that the Council of Ministers decided in its last session to appeal some paragraphs of the budget before the Federal Supreme Court.[/size]
    [size=45]Mazhar Muhammad Salih, the financial advisor to the Prime Minister, said in a statement to (Al-Mada) 4 days ago, that “the government will challenge the 2021 Federal Budget Law before the Federal Court,” indicating that “the House of Representatives has made amendments to the budget that put a constraint and a burden on the executive authority. Including increased expenditures and an increase in the deficit.[/size]
    [size=45]Saleh considered that "the additions made by the House of Representatives to the Federal Budget Law interfere between the work of the authorities," indicating that "the government has the right to appeal these amendments and additions that the Council has introduced before the Federal Court."[/size]
    [size=45]The constitution limits the House of Representatives in Article (62) when it determines its powers and does not make it absolute, as it granted it the procedure of transferring between chapters of the budget chapters and reducing the total of its sums, and he may, when necessary, propose to the Council of Ministers to increase the total expenditures.[/size]
    [size=45]The constitution also gives the government the legal authority to appeal before the Federal Court to cancel and annul the provisions that Parliament added to the Budget Law in accordance with the provisions of Article (13) of the Constitution, as they are unconstitutional.[/size]
    [size=45]And the government advisor continued, "The constitution defines the powers of the House of Representatives by adding paragraphs to the budget law and does not amend, but in the event that there are amendments, they will be in consultation with the government, and on the contrary, the executive authority has the right to file an appeal before the Federal Court on these changes and amendments."[/size]
    [size=45]Saleh continued at the time, that "the number of articles that will be challenged before the Federal Court may exceed ten articles," stressing that "the decision on the constitutionality of these amendments is up to the court to decide."[/size]
