A "legal" split in the Iraqi parliament over Al-Halbousi's decision regarding the President of the Republic
Shafaq News/ The decision of the presidency of the Iraqi Council of Representatives, today, Tuesday, to reopen the nomination for the post of President of the Republic, starting tomorrow, led to a split between parliamentary blocs on the "legal and constitutionality of the decision."
The State of Law coalition, led by Nuri al-Maliki, commented on the decision, calling it "unconstitutional," according to the coalition leader, MP Muhammad Chihod.
Chihod told Shafaq News Agency, "The decision to reopen the nomination for the position of President of the Republic by the presidency of the Iraqi Council of Representatives is a clear constitutional violation," considering that "it is not permissible at all, and that the matter was taken in accordance with political agreements and not legal and constitutional."
Chihod indicated that "the final decision in such constitutional and legal disputes is the Federal Supreme Court, and for this there is an intention from various parties and personalities to challenge this decision with the Federation, as it is a very clear constitutional violation."
For his part, the "Sovereignty" coalition led by Khamis al-Khanjar considered the decision "constitutional and within the powers of the parliament's presidency."
The leader of the coalition, Amjad al-Dini, told Shafaq News Agency, "The decision of the presidency of the Iraqi parliament to reopen the nomination for the post of President of the Republic, for a period of (3) days, is part of the constitutional procedures, and within the powers granted to the Presidency."
And Al-Daini said, "This decision will also be an opportunity for the political forces to reach final agreements regarding the resolution of the presidential candidate, as well as the formation of the new Iraqi government."
Today, Tuesday, the Speaker of the Iraqi Council of Representatives, Muhammad al-Halbousi, decided to reopen the nomination for the position of President of the Republic, after failing to hold the session designated for this purpose.
And most of the parliamentary blocs boycotted the session that was scheduled to be held last Monday to elect a new president for Iraq.
The Presidency of the House of Representatives said in a statement received by Shafak News Agency, that it held a meeting to discuss the issue of electing the President of the Republic, given the expiry of the constitutional period specified for the election according to Article (72/Second/B) of the Constitution without electing a President of the Republic.
In its statement, the presidency noted that "based on the provisions of the Nomination Law for the Presidency of the Republic No. (8) of 2012, and it was decided during the meeting: Opening the door for nomination for the position of President of the Republic, starting from Wednesday, February 9, 2022, for a period of (3) days."
