Today, Sunday, the Ministry of Transport revealed that it had made several communications with the concerned international authorities, through Iraqi diplomatic channels, to restore Iraq's sovereign rights in its maritime fields.
Minister of Transport, Razzaq Muhibis Al-Saadawi, confirmed in a statement: "Several measures have been taken to preserve Iraq's maritime borders, and restore its sovereignty over the navigational channel in Khor Abdullah and the sea lanes in Khor Al-Khafja and Khor Al-Amaya."
Al-Saadawi added, "At a time when Iraq seeks to be a hub for international transit through its ports overlooking the Gulf, and invests huge amounts of money in port infrastructure and the maritime transport sector, we find that the strategic sea lanes in Khawr Abdullah, Khawr al-Khafja and Khawr al-Amaya are in A state of constant threat and abuse from the regional neighboring countries.
And he continued, "The ministry addressed the Ministry of Foreign Affairs to complete the procedures for sending the map of Iraqi maritime areas to the Council of Ministers in order to vote on it."
And he added, “The ministry sent a letter to the Ministry of Foreign Affairs / Legal Department, requesting an appeal against Security Council Resolution No. (833) of 1993, regarding Khawr Abdullah, because of” the damage that occurred to Iraq, and depriving it of its sea view and its historical right to the navigational canal in Al-Khor," pointing out that "that decision was binding and recognized by the government before 2003, but now we are nationally and morally obligated to declare Iraq not to recognize the issue of resolving disputes that the UN Security Council practiced earlier, which caused the loss of an important part of Iraq's water and rights." Al-Saadawi called on the Ministry of Foreign Affairs to "complete the necessary procedures to send the map of Iraqi maritime areas that was approved by the two Diwani committees (123 and 110) for the year 2021 to the esteemed Council of Ministers for the purpose of voting on it and depositing it with the United Nations to be a legal document that protects Iraq's maritime borders."
The minister noted that his ministry "is not concerned with previous international warnings and decisions, but is borne by previous governments, which were based on unstudied laws that those governments risked," referring to the text of the agreement with the countries opposite the coasts of Iraq, without referring to Iraq's historical right to the navigational canal. in Khor Abdullah, considering it a "big historical mistake."
He pointed out that "while negotiations are taking place to demarcate the maritime borders between Iraq and Kuwait, we find that the latter has worked to strengthen its position with documents and arguments deposited with the United Nations," explaining that "the State of Kuwait deposited Emiri Decree No. (317) of 2014 with the United Nations, And declared its full sovereignty over Khawr Abd Allah, and part of the exclusive economic zone of the Republic of Iraq, and Kuwait used in its decree the outer border of outcroppings that appear in the lowest islands (the lowest drop in water) as the base points for its territorial sea.
Al-Saadawi continued his speech that "these outcrops or heights from which water recedes at the islands are located in an overlapping area between the coast of Iraq and the coast of Kuwaiti Bubiyan Island, and Iraq has a sovereign right to these heights in accordance with Article (13) of the United Nations Convention on the Law of the Sea 1982 and ratified by Republic of Iraq by Law No. (50) of 1985.
He concluded, "Based on the foregoing, the ministry requests an appeal against Security Council Resolution No. (833) of 1993 because of the damage that occurred to Iraq and its deprivation of its maritime view and its historical right to the navigational canal in Khor Abdullah."
