    The [url=https://www.alsumaria.tv/Entity/3151326929/%D9%88%D8%B2%D8%A7%D8%B1%D8%A9 %D8%A7%D9%84%D8%A7%D8%AA%D8%B5%D8%A7%D9%84%D8%A7%D8%AA/ar/]Ministry of Communications[/url] stated in a statement received by Al-Sumaria News that it “would like to note to all those concerned with the communications sector the issuance of the Federal Court’s decision No. (233/Federal/2023) dated 10/10/2023 based on the request for interpretation submitted to the court by the Minister of Communications, Hiam Al-Yasiri.” To interpret Articles (110/VI) and (103) of the Constitution, which relate to the work of the [url=https://www.alsumaria.tv/Entity/3151326929/%D9%88%D8%B2%D8%A7%D8%B1%D8%A9 %D8%A7%D9%84%D8%A7%D8%AA%D8%B5%D8%A7%D9%84%D8%A7%D8%AA/ar/]Ministry of Communications[/url] and the Communications and Media Authority, in order to define the tasks of each of them and separate the intersections between them that may negatively affect the progress of work.



    The Federal Court’s interpretation, according to the statement, stated, “With regard to (Article 110/Sixth of the Constitution, which concerns regulating the policy of broadcast frequencies and mail, it is within the jurisdiction of the executive authority as it is one of the federal authorities and according to the tasks of the ministry in charge of that jurisdiction, which is the [url=https://www.alsumaria.tv/Entity/3151326929/%D9%88%D8%B2%D8%A7%D8%B1%D8%A9 %D8%A7%D9%84%D8%A7%D8%AA%D8%B5%D8%A7%D9%84%D8%A7%D8%AA/ar/]Ministry of Communications[/url]), as stated in the Federal Court’s decision.” (It is not permissible to adopt legal texts contained in the Coalition Provisional Authority’s Order No. 65 of 2004 if they violate the Constitution because the legislation of this matter was before the entry into force of the Constitution of the [url=https://www.alsumaria.tv/Entity/47585/%D8%AC%D9%85%D9%87%D9%88%D8%B1%D9%8A%D8%A9 %D8%A7%D9%84%D8%B9%D8%B1%D8%A7%D9%82/ar/]Republic of Iraq[/url] of 2005).”

    The Federal Court’s decision, according to the statement, stated that “constitutional jurisdiction cannot be exercised by independent federal bodies, but rather by federal authorities.”
