    Today, Tuesday, the Council of Ministers held its fifth regular session, headed by Prime Minister Muhammad Shiaa Al-Sudani, and took several decisions, including regarding electronic payment and setting a day for the Holy Qur’an.

    According to a government statement, the Council discussed the general situation in the country, reviewed a number of basic files related to the government’s goals and priorities, as well as deliberating on the topics on the agenda and taking the necessary decisions regarding them.


     
    On the occasion of the noble Prophet’s mission and the Night Journey and Mi’raj, the Council of Ministers agreed to adopt the 27th of the month of Rajab as a day for the Holy Qur’an. So that Iraq will be the first country to mark this day in the annual calendar as part of the national and Islamic days, and to celebrate the Holy Qur’an by spreading its teachings and blessed verses throughout the governorates.
     
    Regarding the Prime Minister’s directives in the field of commissions for electronic payment operations, the Council of Ministers approved the following:
    1. (The recipient shall bear electronic payment commissions from the private and public sectors, and the payer shall not bear any commissions for electronic payment), and the government shall compensate a percentage (50%) of Electronic payment commissions paid by the holder (the merchant, the employer, and all private sector entities), provided that they are used to pay the holder’s obligations to the state exclusively through electronic payment, such as renewing licenses, paying taxes, customs, fees, municipal fees, electricity fees, and everything owed to the state, and they cannot be recovered in cash in the Anyway.

    2. Determine all electronic payment commissions (at a percentage determined by the Central Bank of Iraq), with a maximum commission limit that stops at a commission amount (the value of which is determined by the Central Bank of Iraq for both the public and private sectors) and what exceeds that without commissions, and a minimum that is exempt from commissions as well ( Exempting small transactions in the public and private sectors from commissions up to a ceiling determined by the Central Bank of Iraq.
    3. The contracts signed based on what was stated in the decisions of the Council of Ministers related to electronic payment, especially the decisions of the Council of Ministers (23044 and 23620 of 2023) between state institutions and electronic payment companies, will continue to be effective until December 31, 2024, and the contracting institution may submit a reasoned request to the Central Bank of Iraq in If she wishes not to extend the approval process.
    4. The decision will be re-evaluated in light of the results of the application before the end of this year, 2024. 5. This decision will be implemented starting March 1, 2024.

     
    In the foreign relations file, it was approved to authorize the Deputy Prime Minister, the Minister of Foreign Affairs, with the authority to negotiate and sign the draft partnership and cooperation agreement between the Government of the Republic of Iraq and the Government of the United Kingdom, based on the provisions of the Constitution, and for the Ministry of Foreign Affairs to prepare the necessary authorization document on behalf of the Government of the Republic of Iraq for the Minister of Foreign Affairs, According to the approved contexts, and submit it to the General Secretariat of the Council of Ministers; In order to obtain the signature of the Prime Minister, taking into account the observations made by the State Council in its legal advice, the opinions of the relevant ministries and authorities, and the observations of the Legal Department in the General Secretariat of the Council of Ministers.
     
    In the process of moving forward with reorganizing some imports and protecting the local product, the Council of Ministers approved the recommendations of the competent authority in the Ministry of Industry and Minerals (Department of Industrial Development and Regulation), based on the provisions of the Iraqi Products Protection Law (11 of 2010), amended according to the following:
    1. Imposing an additional customs fee A percentage of (60%) of the unit of measurement of the product (printed and non-printed plastic bags of various sizes) imported into Iraq from all countries and origins, with the customs item (39232130) for a period of four years without reduction, and monitoring the local market during the period of application of additional customs duties.
    2. The Ministry of Finance/General Authority of Customs applies the additional customs duty for the aforementioned product and notifies the Ministry of Industry and Minerals/Department of Industrial Development and Regulation with a periodic notice about the quantity of Iraq’s imports of the aforementioned products, the value of the additional customs duties levied on the importer of the foreign product, and the imported value. Exporting countries and importing parties.
    3. The Ministry of Industry and Minerals takes into account the following:
    the amount of increase in imports compared to the previous three years to determine the extent of the unjustified increase, and to indicate the ability of the complaining company to meet the market need, ensuring that prices do not inflate, and to determine the importance of the required protection for the national economy.
    4. The regulatory authorities shall review the effects resulting from imposing additional customs protection on the imported product, and this decision shall be implemented after (120) days from the date of its issuance.

     
    In order to complete the new cities file, the Council of Ministers agreed to authorize the Minister of Construction, Housing, Municipalities and Works to sign the contract regarding the Ali Al-Wardi residential city project, with the company implementing the project, and to instruct the National Investment Authority to issue an investment license for the aforementioned city.
     
    In the energy file, the Council of Ministers agreed to increase the total cost of the project to construct and rehabilitate the electricity networks (Al-Rifai - Al-Fajr - Al-Qalaa) by (821,621,000) dinars, so that the total cost became (3,706,621,000) dinars, which represents (28.4%) of the project. The adjusted cost, and a percentage of (35%) on the approved cost, and Dhi Qar Governorate bears the accuracy of the information submitted to the Ministry of Planning.
     
    As part of the continuous follow-up of the school buildings file, the Council of Ministers approved two projects (completion of the new Nasiriyah warehouse and model school buildings funded by the Chinese agreement), based on the provisions of Article 2/Axis Two/The Chinese Agreement, of the Federal General Budget Law No. 13 of 2023.
    The recommendation of the Ministerial Council for the Economy (24018 BC) was approved as follows:
    1. Approval to exempt contracting fish farm owners in accordance with Resolution (995 of 1985) from rental fees for the years after 2019 until December 31, 2023, at a rate of (50%).
    2. Excluding fish farm owners from the exemption for the years for which they were compensated; Due to the damage to their farms, according to what was recorded in the letter of the Ministry of Agriculture, dated December 21, 2023.
    3. The Ministry of Water Resources is responsible for taking the necessary measures to identify fish farms with an unsustainable water quota, in coordination with the Ministry of Agriculture for the purpose of terminating the contracts in force.

     
    The Council also approved the recommendation of the committee formed pursuant to Diwani Order (22449), regarding the proposal to establish a land data management center according to the letter of the Ministry of Construction, Housing, Municipalities and Public Works on November 15, 2023. The Ministry of Water Resources is responsible for completing the establishment procedures and work requirements, and the committee also continues to supervise the project. Until it is completed.
     
    Within the framework of the government effort to implement service projects in the governorates and speed up their completion according to the approved time limits, the Council of Ministers approved a number of decisions in this regard, which are as follows:
    First:
    1- Increasing the reserve percentage for the component (design and implementation of Al-Fadhiliya Hospital, capacity (200) beds) by ( 1.69%) of the contract amount, which represents an amount of (1,623,019,000) dinars, becoming (34.77%) instead of (33.08%), and the total adjusted cost of the component after the increase will be (132,260,699,000) dinars.
    2- Increasing the reserve ratio The component (design and implementation of the People’s Hospital, capacity (200) beds) is reduced by (3.75%) of the contract amount, which represents an amount of (3,608,250,000) dinars, so that it becomes (24.58%) instead of (20.83%), and the total adjusted cost is ( (122,610,650,000) dinars.
    3- Increasing the reserve percentage for the component (design and implementation of Al-Hurriya Hospital with a capacity of 400 beds) by (2.68%) of the contract amount, which represents an amount of (4,627,139,600) dinars, to become (22.549%) instead of ( 19.86%), and the total adjusted cost will be (216,006,627,600) dinars.
    4- Increase the total cost of the design and implementation project (Al-Shaab and Al-Fadhiliya (200) beds, Al-Hurriya (400) beds, and Al-Numan Hospital development 2011) by (9,858,408,600) dinars. ; The result of calculating the new spare orders for the three hospitals resulting from the addition of (treatment station + lifting station + replacing the cooling system + display screens) so that the total cost of the main project after the increase amounted to (555,819,399,956) dinars, with an increase rate of (11.997%) over the approved cost and a percentage increase (1.8%) on the total adjusted cost of the project.
    5- The committees that prepared and checked the tables of quantities for the spare parts order in Baghdad Governorate and the Ministry of Health bear full responsibility for the accuracy of the data, prices, and specifications approved in the tables of quantities that were prepared, regarding adding the central treatment station and the lifting station, and responsibility for determining the required central treatment station capacity; The fact that the consulting company supervising the project, the research center, and the consulting office in the governorate disclaimed their responsibility regarding the legal and contractual aspects and only the technical aspects were approved; The contract is executed in a turnkey manner.
    Second:
    1. Increasing the reserve percentage for the component (supervising the implementation of the sewage project in the districts of Al-Shirqat, Baiji, and the Al-Qadisiyah neighborhood in Tikrit) to become (17.81%) instead of (zero).
    2. Increasing the cost of the supervision component of the implementation of the sewage project in the districts of Al-Shirqat, Baiji, and Al-Qadisiyah neighborhood in Tikrit by (2,157,932,817) dinars, to become (14,641,932,817) dinars, i.e. a percentage of (17.3%).
    3. Increasing the total cost of the project to implement sewage and rainwater sewer networks with lifting and pumping stations (for sewage and rainwater), with treatment plants (5) for the districts; Al-Touz, Baiji, Balad, Al-Sharqat, Tikrit, and Al-Qadisiyah neighborhood, with the preparation of a study, designs and implementation of treatment plants in Baiji and Al-Sharqat at an amount of (2,157,932,817) dinars, to become (562,348,401,248) dinars, i.e. an increase of (12.61%) over the total approved cost. And a percentage increase of (0.39%) on the total adjusted cost.
    Third: Increasing the reserve ratio for the contract (Construction of the Land Hajj Road/First Phase with a length of 50 km), one of the components of the project (Construction of the Land Hajj Road with a length of 239 km in stages), which is included in the investment budget tables of the Ministry of Construction, Housing, Municipalities and Public Works/Department of Roads and Bridges, For the year 2023, it becomes (34.9%) instead of (10%) of the contract amount, and within the total cost of the project.
    Fourth:
    1. Increase the reserve percentage for the project (establishing the Nineveh Passenger Transport Station), to become (33.61%) instead of (22.08%) after rounding.
    2. Increase the total cost of the aforementioned project by (2,690,590,802) dinars, to become (31,903,014,884) dinars, with a percentage increase over the approved cost (27.61%) and over the modified cost (9.21%).
    Fifth:
    1. Creating a component (supplementary works for the Balad city treatment plant/m2 in Salah al-Din Governorate, with the preparation, implementation, operation, and maintenance/m2 of the treatment plant) at a total cost of (14,451,935,564) dinars, including the reserve amounts (7%) and supervision and control.
    2. Increase the reserve amount (12,189,595,391) dinars, so that the reserve percentage becomes (100.5%) instead of (7%).
    3. Increase the cost of the component by the same amount as the increase in the reserve amount, to become (26,641,530,955) dinars, instead of (14,451,935,564) dinars, with an increase rate of (84.34%).
    4. Increasing the total cost of the (Balad sewers/m2) project by (12,953,180,249) dinars, to become (37,953,180,249) dinars, with an increase rate of (51.81%) over the total cost.
    5. The Ministry of Construction, Housing, Municipalities and Public Works/General Directorate of Sewerage shall bear the validity and accuracy of the information sent to the Ministry of Planning, and responsibility for prices and specifications. Being the competent authority.
    6. Considering the violation referred to the Ministry of Construction, Housing, Municipalities and Public Works, due to it referring supplementary works without approaching the Ministry of Planning and providing it with the listing requirements for the purpose of updating the total cost and obtaining the required approvals.
    Sixth:
    1. Increasing the reserve percentage for the project component (implementation of infrastructure for the remainder of the New Mishraq) by (14.365%) to become (24.632%) after rounding, instead of (9.997%), one of the components of the project (infrastructure work for areas in the center of Basra Governorate). Number 17), and within the total cost of the project.
    2. Emphasizing Basra Governorate’s accuracy in preparing bills of quantities for projects, taking into account future expansions of the region; Due to the increase in housing and the addition of new streets, especially since the project in question was listed in 2019 and is subject to the controls attached to the instructions for implementing government contracts (2 of 2014).
    3. Basra Governorate bears responsibility for the accuracy and validity of the information stated in the letter of the Ministry of Planning, dated January 17, 2024.
    Seventh:
    1. Increasing the reserve percentage for the project (construction of the classroom building for the College of Nursing in Fallujah) in Anbar Governorate, which is included as a component of the project (design and implementation of the College of Nursing building for the University of Fallujah), at a total cost of 10 billion dinars, by (21.341%) to become (35.201). %) instead of (13.86%), within the total cost of the main project, taking into account all spare orders issued by Anbar Governorate. The governorate bears responsibility for all data submitted to the Ministry of Planning at the listing stage and the division of the project upon referral, and the violation is confirmed. On Anbar Governorate regarding the violations recorded in the letter of the Ministry of Planning, dated January 21, 2024.
    Eighth:
    1- Updating the costs of (5) components within the project (cladding a main road and residential shops) included in the investment budget tables of the Baghdad Municipality for the year 2023. ; As a result of merging the works (cladding and water networks) of the components (Shops 627, 639 and 641); And referring it for implementation without approaching the Ministry of Planning; To update the costs of these components before the referral, in addition to the referral at a higher than the estimated cost for the locality component (Al-Rashad 774) outside the powers of the contracting party, amounting to (10%), and to update the estimated statements for the component (Abu Mahdi Al-Muhandis Street from Umm Al-Tubul to the halls in both directions), according to the details of the established schedule. In the letter of the Ministry of Planning dated January 21, 2024.
    2- Increasing the total cost of the aforementioned project to become (160,582,445,140) dinars, at a rate of (21.88%) (over the approved cost), and changing the name of the project to become: (Coating roads and residential shops with the implementation of networks Water for shops 627, 639 and 641).
    3- Changing the name of the component (Abu Mahdi Al-Muhandis Street from Umm Al-Tubul to the halls in both directions), to become (Rehabilitation of Abu Mahdi Al-Muhandis Street/First Phase).
    4- Raising the following components of the project (development and rehabilitation of dilapidated pure water networks for residential neighborhoods) included in the investment budget schedules of the Baghdad Municipality for the year 2023; Due to merging it with the project mentioned in Paragraph (1) above, and reducing the total cost of the project to become (38,368,988,592) dinars:
    A. Preparing and extending ductile pipes for pure water to renew the Mahalla network 627.
    b. Preparing and extending ductile pipes for pure water to renew the Mahalla network 639.
    C. Preparing and extending ductile pipes for pure water to renew the Mahalla network 641.
    5. Confirming the violation against the Baghdad Municipality; As a result of it changing the description and costs of the components for the residential shops (627, 639, and 641), referring them for implementation at a higher than their estimated cost, and referring the shop (774/Al-Rashad) outside the authority of the head of the contracting authority with the authority of the Council of Ministers/Ministerial Council for the Economy, more than (10%) without approaching the Ministry. Planning to obtain regulatory approvals.
    Ninth:
    1- The Ministry of Construction, Housing and Municipalities/General Directorate of Sewerage separates the remaining works for the (42) neighborhoods from the contracting works, and for the entire project and includes them within the rehabilitation work contracts, with the exception of the neighborhoods in which they have been started, which amount to (7) neighborhoods. Implemented rehabilitation work within the food security program for Diwaniyah Governorate.
    2- The contracting company will complete the work of the treatment plant, the main conveyor lines, and the payment lines. Because the pipes are 100% equipped.
    3- Proceed with the procedures for separating the work of lifting stations into a separate company, in accordance with the decision of the Ministerial Council for the Economy (230167 Q).
    4- Implementation of additional neighborhood works by a separate contract, in accordance with the decision of the Ministerial Council for the Economy (230167 Q).
    Tenth: Approval of the first option recorded in the letter of the Ministry of Planning, dated December 26, 2023, regarding spare orders (3 and 4) for the Diwaniyah sewerage project, and authorizing the Deputy Prime Minister and Minister of Planning with the financial powers to implement the proposal that is approved, as an exception to the decision.     1- Increasing the reserve percentage for the component (design and implementation of Al-Fadhiliya Hospital capacity) 200 beds, at a rate of (1.69%) of the contract amount, which represents an amount of (1,623,019,000) dinars, becoming (34.77%) instead of (33.08%), and the total adjusted cost of the component after the increase will be (132,260,699,000) dinars.
    2- Increasing the reserve percentage for the component (design and implementation of the People’s Hospital with a capacity of (200) beds) by (3.75%) of the contract amount, which represents an amount of (3,608,250,000) dinars, to become (24.58%) instead of (20.83%) and will be The total adjusted cost is (122,610,650,000) dinars.
    3- Increasing the reserve percentage for the component (design and implementation of the 400-bed Al-Hurriya Hospital) by (2.68%) of the contract amount, which represents an amount of (4,627,139,600) dinars, to become a percentage of (22,549). %) instead of (19.86%), and the total adjusted cost will be (216,006,627,600) dinars.
    4- Increasing the total cost of the design and implementation project (Al-Shaab and Al-Fadhiliya Hospitals (200) beds, Al-Hurriya (400) beds, and the development of Al-Numan Hospital 2011), by ( 9,858,408,600) dinars; The result of calculating the new spare orders for the three hospitals resulting from the addition of (treatment station + lifting station + replacing the cooling system + display screens) so that the total cost of the main project after the increase amounted to (555,819,399,956) dinars, with an increase rate of (11.997%) over the approved cost and a percentage increase (1.8%) on the total adjusted cost of the project.
    5- The committees that prepared and checked the tables of quantities for the spare parts order in Baghdad Governorate and the Ministry of Health bear full responsibility for the accuracy of the data, prices, and specifications approved in the tables of quantities that were prepared, regarding adding the central treatment station and the lifting station, and responsibility for determining the required central treatment station capacity; The fact that the consulting company supervising the project, the research center, and the consulting office in the governorate disclaimed their responsibility regarding the legal and contractual aspects and only the technical aspects were approved; The contract is executed in a turnkey manner.
    Second:
    1. Increasing the reserve percentage for the component (supervising the implementation of the sewage project in the districts of Al-Shirqat, Baiji, and the Al-Qadisiyah neighborhood in Tikrit) to become (17.81%) instead of (zero).
    2. Increasing the cost of the supervision component of the implementation of the sewage project in the districts of Al-Shirqat, Baiji, and Al-Qadisiyah neighborhood in Tikrit by (2,157,932,817) dinars, to become (14,641,932,817) dinars, i.e. a percentage of (17.3%).
    3. Increasing the total cost of the project to implement sewage and rainwater sewer networks with lifting and pumping stations (for sewage and rainwater), with treatment plants (5) for the districts; Al-Touz, Baiji, Balad, Al-Sharqat, Tikrit, and Al-Qadisiyah neighborhood, with the preparation of a study, designs and implementation of treatment plants in Baiji and Al-Sharqat at an amount of (2,157,932,817) dinars, to become (562,348,401,248) dinars, i.e. an increase of (12.61%) over the total approved cost. And a percentage increase of (0.39%) on the total adjusted cost.
    Third: Increasing the reserve ratio for the contract (construction of the land Hajj road / first phase with a length of 50 km), one of the components of the project (construction of a land Hajj road with a length of 239 km in stages), which is included in the investment budget tables of the Ministry of Construction, Housing, Municipalities and Public Works / Department of Roads and Bridges, For the year 2023, it becomes (34.9%) instead of (10%) of the contract amount, and within the total cost of the project.
    Fourth:
    1. Increase the reserve percentage for the project (establishing the Nineveh Passenger Transport Station), to become (33.61%) instead of (22.08%) after rounding.
    2. Increase the total cost of the aforementioned project by (2,690,590,802) dinars, to become (31,903,014,884) dinars, with a percentage increase over the approved cost (27.61%) and over the modified cost (9.21%).
    Fifth:
    1. Creating a component (supplementary works for the Balad city treatment plant/m2 in Salah al-Din Governorate, with the preparation, implementation, operation, and maintenance/m2 of the treatment plant) at a total cost of (14,451,935,564) dinars, including the reserve amounts (7%) and supervision and control.
    2. Increase the reserve amount (12,189,595,391) dinars, so that the reserve percentage becomes (100.5%) instead of (7%).
    3. Increase the cost of the component by the same amount as the increase in the reserve amount, to become (26,641,530,955) dinars, instead of (14,451,935,564) dinars, with an increase rate of (84.34%).
    4. Increasing the total cost of the (Balad sewers/m2) project by (12,953,180,249) dinars, to become (37,953,180,249) dinars, with an increase rate of (51.81%) over the total cost.
    5. The Ministry of Construction, Housing, Municipalities and Public Works/General Directorate of Sewerage shall bear the validity and accuracy of the information sent to the Ministry of Planning, and responsibility for prices and specifications. Being the competent authority.
    6. Considering the violation referred to the Ministry of Construction, Housing, Municipalities and Public Works, due to it referring supplementary works without approaching the Ministry of Planning and providing it with the listing requirements for the purpose of updating the total cost and obtaining the required approvals.

    Today, Tuesday (January 30, 2024), the Council of Ministers issued a decision regarding commissions for electronic payment operations.
    The Council of Ministers said in a statement received by “Baghdad Today” that it agreed to the following:
    1. (The holder bears electronic payment commissions from the private and public sectors, and the payer does not bear any commissions for electronic payment). The government compensates 50% of the electronic payment commissions paid by the holder (the merchant, the employer, and all private sector entities), provided that they are used in Paying the holder’s obligations to the state exclusively through electronic payment, such as renewing licenses, paying taxes, customs, fees, municipal fees, electricity fees, and everything owed to the state, and they cannot be recovered in cash under any circumstances.
    2. Determine all electronic payment commissions (at a percentage determined by the Central Bank of Iraq), with a maximum commission limit that stops at a commission amount (the value of which is determined by the Central Bank of Iraq for both the public and private sectors) and what exceeds that without commissions, and a minimum that is exempt from commissions as well ( Exempting small transactions in the public and private sectors from commissions up to a ceiling determined by the Central Bank of Iraq.
    3. The contracts signed based on what was stated in the decisions of the Council of Ministers related to electronic payment, especially the decisions of the Council of Ministers (23044 and 23620 of 2023) between state institutions and electronic payment companies, will continue to be effective until December 31, 2024, and the contracting institution may submit a reasoned request to the Central Bank of Iraq in If she wishes not to extend the approval process.
    4. The decision will be re-evaluated in light of the results of the application before the end of this year 2024.
    5. This decision will be implemented starting March 1, 2024.
